French test result rejected

Guys I would like to share my situation in hopes of finding a solution to solve this problem.

In September, I submitted my application for the CSQ through the PEQ program with the french test result TEFaQ (Test d'évaluation de français pour l'accès au Québec). I got a double B2 for listening and oral. Later that month, I received a letter from the MIDI informing me that they would need more time for the verifications of my documents. In early October, I received an email from the organisation that provides this test. In the email, the MIDI demanded the organisation to redo the evaluation of my oral expression and the organisation has now decided to lower my grade from B2 to A2, which I do not understand why. And then, there is no further news from the MIDI.

To handle the situation, I wrote a letter to the MIDI to ask for a grace period so that I can retake the test and prove that I actually have a B2 level. I also attached the receipt of new TEFaQ that I was going to take on the 26 October. However, the MIDI has not responded to me. Anyway, I still retook the test and this time, I got a C1 for expression orale. I submitted the new result as well as an explanation letter including my file number to the MIDI last week and I even took another french exam TCFQ (still waiting for the result).

The exam that got downgraded was taken in April. I admit that my French was not that good in April and I was also surprised to achieve a B2. However, I have nothing to do with the evaluation part. I swear to god that I did nothing to modify the result or anything. I just took the exam myself. It was not me that gave myself a B2. I mean if I had known that it was not actually a B2, I would have retaken the exam until I could achieve a B2 but I did not know it.I did not bribe or cheat or anything. I have spent more than 2 months waiting for nothing. I simply do not know why I deserve to be punished that way. And now, I am stuck here with no news from the MIDI.

I just want to ask you guys a few questions.

1. If the MIDI has not officially required me to submit supplementary documents, am I allowed to submit extra documents myself like what I just did for the French exam result? Will they accept them?

2. I have already retaken the exam and submitted the most updated result. Do you think there is still anything I can do?

I have already done everything I could to correct the problem. I am just frustrated now. Does anyone have similar experience or know what I can do to deal with the situation professionally? Thank you in advance.

I am aware of this option (submitting another application). On the application forms, there is a question asking whether I have already applied for CSQ / permanent residency before. Apart from yes and no, we can also choose "en attentant une décision". However, I am not sure if this function is for everyone. I have an impression that this is for candidates that want to add family members, but not for candidates having a situation like me. Also, I don't really know if they would allow me to do that even if I pay them extra money. I don't want to make the MIDI angry and sabotage my first application. Oh god I am so confused now.

Sorry if I was not clear in my last post. I did not ask you to send out 2nd application, I just asked to prepare 2nd application in case first is rejected. If you get rejection letter then only send out 2nd application.

Also, you can appeal against rejection:

I heard from one of the guys working in LBP that many colleges are under investigation for issuing French B2 certificates and also providing B2 Tefaq score at a higher cost. MIDI verifies through the recorded conversation for your french B2 skills and then asks these institutes to re-evaluate the test scores. What he told me that there was a chinese syndicate facilitating all this at a cost.

Option for you is to get TEFAQ done at another centre of repute and then provide result or if you get good TCFQ result provide that. MIDI is issuing letter of rejection with an option to apply under Regular Skilled Worker category which is nightmare as it might take 6-9 months for csq alone and federal PR process is also moving at snail pace so you need to act fast and decisively.

All the best

Thank you. I have already taken the TEFaQ in another institution and even submitted the C1 result to the MIDI. The problem is that my grade got lowered from B2 to A2 and then raised back to C1 like a roller coaster, so I am sure that they are going to give me a hard time. I hope that they can understand that there is a gap of 6 months between the 2 tests and just let me go. For my TCFQ, I already know that it is a B2 for the listening part, I hope the oral part will also be a B2 when I get the result. Thanks for the information.

All the best buddy. yes you have fair bit of explanation to do but going by the gap anyone can have improvement in their language skills. There's no harm in consulting with a immigration lawyer (first consultation free) as then you will feel more comfortable.

Congrats buddy. You have been wronged by MIDI. I hope they don't harass you any further.

All the best.
To be fair MIDI did not wrong me. MIDI was just doing its job to verify the results. It is the examination centre for the TEFaQ that wronged me. I just submitted the new result today. I really hope that they are going to accept these documents.

I'm Chinese (probably has something to do with my application). Now I entered a hopeless stage. I really did what I could to verify a B2 level, but I cannot do anything unless informed by MIDI. They still haven't come to a decision yet.

Great. Your english is quite good as well and I believe you have worked really hard for your French.

I will advise you again to contact any immigration lawyer for the sake of comfort. I am positive that outcome of
your issue will be favourable to you.

Wish you all the best.

The worst outcome is that they will reject my application. The waiting time is going to be a nightmare though thanks to bureaucracy. I honestly pray to god every day that they reject my application as soon as possible (I know it sounds weird lol), so that I can submit the application again with multiple evidence of my French. I just wish they would allow applicants like me to reapply for free since it is really not our responsibility to have our French misevaluated by the exam centres.

Anyway I will keep you updated.

Have you tried contacting David Chalk. I read about him on internet only. His lawfirm is representing cases like you. Give a try. No harm. I don't know much about them but the situation you are in it would be beneficial, I guess.

All the best buddy.
