Hi.
I just have a simple question.
Do they new rules for sponsorship affect people with a current undertaking that start before the changes took effect?
My current undertaking of sponsoring my partner(now my exhusband) took place in early 2014 when he got a pr card. The next year he divorced me.
I am just wanting to know do my obligations toward the sponsorship agreement fall under the old rules at the time I signed the papers or the new rules...because I don't understand how they can change the rules for me AFTER i signed the papers..because the new rules say you cannot start a new undertaking until ten years after the last under taking.
That's stinks because my last undertaking was for an unloving, messed up man who put me in a bad situation and hurt me bad, and now I have a wonderful man who actually loves me as I deserve, he cares and respects me and I have never met anyone anywhere in the world who unconditionally loves me like him, but I can't sponsor him if the new rules apply to my old sponsorship as well as a new one. What I know is that the old rules let you sponsor someone after three years from the last undertaking...and the rules let you sponsor again after ten years only.
Please help me get the real facts
Thank you kindly.

What changes? The length of undertaking for a spouse is still 3 years, so I'm not sure of this 10 year rule you are talking about. As soon as your previous undertaking is over (so 3 years after landed as PR), you are then free to sponsor someone new.

10 year undertakings are only for dependent children.

Oh thanks so much
Obviously the person who told me about the ten year rule is an incredibly mean liar and I should have know that and not expected any more from him as he lies consistently.
I also called the CIC and they verified the same thing you just told me.
I guess my heart is just too big sometimes...
Even I want to believe the liars I know but not anymore!

You can read the rules for yourself here also: http://www.cic.gc.ca/english/information/applications/guides/5289ETOC.asp
You may not be able to sponsor if you…
  • signed an undertaking for a previous spouse or partner and it hasn’t been three years since they became a permanent resident,
The only thing that will complicate your case, is if your ex-spouse took social assistance while on your 3 year undertaking.
