HI someone can give me answer. So my family sponsorship was been denied and now I'm on processing of AID cuz the decision it's not right. Anyway my questions is do you think my paper have a chance to win this problem. My paper there's is a circumstances and I guess is my mistaked too. But I have all evidence to proved it.

So thisbis the story when my mom sponsored me i was 13years old and and my status was single So since 2007 i have girlfriend. But i came in canada 2013 and im still single. Then me and my girlfriend found out that shes pregnat after a month when i land here. So i want back home 2015 to get married. So then I fill up the sponsorship paper and I wrote in cohabitation is 3 years. But what I understand about cohabitation u just living with someone but me and my girlfriend is not common law? We're living together but not for 3 years straight there's is a gap. And my mistaked I didn't not say that there's is a gap so they think I have already partner before I land here. The cic denied my papers cuz they think my family is not member of family class? Even tho I have evidence that I'm single even my wife now and I got witness too. Cuz that time were not declaring were common law at that time were just girlfriend/boyfriend I just wanna know if my paper have a chance to win this case cuz right now I already spend $10k so I don't wanna spend more if my case don't have chance?

At any point before your PR landing, did you live together for 12 consecutive months as girlfriend/boyfriend?

We live together but we don't live for 12 months straight. But on the paper I fill up I wrote on cohabitation is 3 years but that's my mistaked cuz I did not explain that were not common law and we're not living for 12 months consecutive. So there is circumstances. That's what I'm appeal for to prove and tell them were not common law.
 
The forms you filled in state that you lived together for three years, so of course the visa officer thought you were common-law. Since you did not live together for 12 consecutive months, you were not common-law, and so should be able to sponsor your wife. However, because of the forms you submitted, you will need a lot of proof that you misunderstood the term 'common law' and 'cohabitation' and that actually you were never common-law partners.
I think having a lawyer for your appeal would help.
 
Agreed, make sure you are doing this with a good immigration lawyer. If you lose this appeal you will never be able to sponsor your partner to Canada, ever.

You need to prove you each had separate addresses so there was never a point in the past that you lived together for 12 months.

Note that all it takes to become common-law is to live together 12 months as boyfriend/girlfriend. There is nothing to "declare", you simply become common-law for immigration purposes after 12 months cohabitation.
