I'm a US Citizen working for a US company, looking for issues with telecommuting during my visits. (Example: drive across the border for a long weekend, continue my normal work from a coffeeshop during the days I'm there.)

It seems like there should be no issues, but I need official proof, and can't find it. (And really, this seems like such an easy question!)

  • My company has no presence in Canada.
  • I am not interacting with any person or company in Canada in any way in the course of my work, regardless of where I do it from.
  • I will be in Canada for less than a week at a time, significantly less than 6 months per year total (more likely 3 months at most).


I can't find anything official from the US perspective.

From Canada's perspective, it looks like a non-issue, since it wouldn't even be considered work:

What kind of activities are not considered to be “work”?
  • An activity which does not really 'take away' from opportunities for Canadians or permanent residents to gain employment or experience in the workplace is not “work” for the purposes of the definition.
Examples of activities for which a person would not normally be remunerated or which would not compete directly with Canadian citizens or permanent residents in the Canadian labour market and which would normally be part-time or incidental to the reason that the person is in Canada include, but are not limited to:
  • long distance (by telephone or Internet) work done by a temporary resident whose employer is outside Canada and who is remunerated from outside Canada;

No issue at all.

For each reentry you will be questioned on why you are visiting so frequently. Be sure to carry evidence.

Thanks for the reply @Jalex23! Any chance you have any official US sources you can point to for proof? I'd like to have an ironclad case to bring to HR, but its oddly hard to make one...

I don't think the USA cares about Canadian policies... they are not of their concern.

If you are looking for the USA policies then you will need to ask that in a USA immigration forum, I'm afraid.
