Hi All,

I have few questions about my current situation..

so, I am currently an international student in Canada which means I have my study permit here. I just got married with my wife who is a Canadian citizen here. We are going to apply for spousal sponsorship but I don't want to apply for school because I don't want to pay more money while I have a chance to pay less money for school when I am a permanent resident of Canada. Because, I believe I can use that money for our life or something else in our life. I am wondering, if it would be a problem for our application or to prove our marriage is genuine?? or because of I am here on my student visa would the government send me back to my country?? I am looking forward to here from you guys all.

Thank you.

Since you give no details at all around your relationship or marriage, how could anyone possibly say?

First of all, I am sorry you are right.. so, the wedding took place in Toronto with the attending of her family(her parents, grandmother, aunt, uncle, some friends). I only had my brother since my parents in my country and was not able to be here due to some problems. After our wedding we went on vacation for our honeymoon. Now, I wanna take her to my country to meet my whole family but she wont be able to go till in the middle of August. However, August 18 is due date for tuition fees. I don't know what I can do at this point. If I don't pay at the time and they contact with the immigration border, they might not let me enter Canada when I am back from my country. or how does this process work?

Second of all, I don't want to pay for school because I don't want to pay more money while I have a chance to pay less money for school when I am a permanent resident of Canada (My international tuition 22K-Residence tuition 8K and have a chance to get osap). But, I don't know if not applying for school for the next year would affect my application in a way of proving our relationship is genuine. Would it affect or not?

How long were you in a relationship before getting married?

Note that it will take around 1 year or so even after you submit the PR app, to get approved and become a PR. In general the PR app will have nothing to do with whether or not you're in school.

I believe some schools may allow you to pay domestic tuition fees if you have a PR app in progress, but you need to check with the school on their policy.

We were in a relationship for 7 months before we got married. Also, she is 7 years older than me. Just a little information you might want know.

Well, short answer is Yes, it will impact on your application at some levels. If you don't pay tuition, you will be out of status and it will raise the question by CIC. And it will get you in a very limbo situation, if CIC decided to investigate your case. Your situation is not alone, a lot international students did the same thing (Some are genuine, some are not), that move really alarmed CIC, and eventually CIC swept most the cases (Not just cases in process, but also include cases that had been approved, and applicant had obtained PR for years. You can search "Project Honeymoon".

so which way do you think they can blame us on having a fake marriage to get a status in Canada as long as we are married couple who support each other in every way? Also, how much impact you think it would make on our application?

The first question you asked is very specific and nobody would give you an answer except the officer who reviews your case. No offense, but all the faked marriages couples claimed they were in genuine marriage and supported each other before they got caught by CIC. To you, my suggestion is that it is not worth it to risk your application/case, just for saving couple K or even 10K dollars.

Regarding your second question, the minimum impact on your case would be that if CIC does raise their eyebrows on your case, it will substantially delay your case's process.

7 months is a relatively quick relationship before getting married. Why did you decide to marry her without introducing her to your family? Would this or the fact she's older be seen as unusual based on your own culture/religion?

IRCC may see the marriage as one done only for the purpose of immigration. Of course each case is different so yours will depend on how much evidence of the genuine relationship/marriage you can provide.
