Bonjours everybody - I am new to this forum and I am glad that I found you!

I am Canadian working in US, and my fiancee is from France. He has overstayed his US visitor's visa.

Now we want to move out of US, but to get our visa in New Zealand, we need a police background check here in US. So I'm thinking that he should go to Canada for a while until the US check is done.

Does anyone know if he can come visit Canada? Will they stop him at the border?

No one can say for certain, but if Immigration notes his overstay in the US, they are going to assume that he will overstay in Canada. If they make that decision, they will refuse.

Oh dear, that's bad.
What if we bought a plane ticket which would indicate that we plan to leave?
It's exactly what we wish to do. We want to get married in Canada then fly away.

Has anybody in this forum been refused entry when overstayed in US?

If he has a return plane Ticket to France, I doubt he will be refused. I have crossed the border multiple times from USA to Canada back and forth and some officers go as far as calling the US border officers to make sure I was admissible back to the states. I can only speak out of my own experience but if he buys the return plane ticket and shows it, he should be fine. Even if he didn't buy it, he most likely would not get refused but better not to take risks!

You've replied to a post that's nearly 11 years old :)

I wonder what happened to them at the end. Hope it's a happy ending.
