Ganun po ba, so ok lang pala yun kaseang sabi sa st lukes May 15 lang nasend. So it takes some time pala. Kase base sa iba ko po nadidinig ung kanila is after a day or 3. Grabe st lukes. Did u have to do hepa screen kase daw nurse grad? And mmr?

Since you were married in the Philippines your marriage still stand. Even if you get married in hongkong your papers will still be processed in Manila Visa Office, and they will need PSA documents which will show you are legally married to the new guy, but unfortunately you cannot since your old marriage still stands. The solution is you have to hire a lawyer in the Philippines and apply for a Recognition of Foreign Divorce, which like the name states will legally recognize your divorce in Canada, the caveat is that you must be a Canadian Citizen already when you were divorced. This is a lengthy process, you will go through hearings and such, then after the court says it is recognized then it will direct PSA to put annex to your previous marriage certificate that a divorce was recognized then that is the time you can get married then sponsor your new husband. It took me 3 years for the entire process.

Yes you can apply for common law if you can prove that you have lived with him for at least a year, you can invite him to visit but as far as I know, you cannot marry someone with visitor status, the best option is to find him a job here, once he is here, get married here.

Wow thank you so much that is what exactly I want to hear you answer my question perfectly and yah I live with him in philippines for six years now and he takecare my son as well but my son just got here so I want him to come as well.

There you go, sponsor him as a common law, 6 years is more than enough. I think that is the fastest way to bring him to canada.

There's a lot of point that needs clarification here...are you a PR or Canadian citizen ?
If you are a Canadian citizen when you filed for divorced you can get married in HK as they do recognized divorce you just have to bring your divorce papers there ...but if your are divorce and still and Filipino citizen you still have to have the marriage annuled in the Philippines , recognition of Foreign Divorce are only applicable to Filipinos who has acquired a foreign citizenship thus making them non Filipino citizens anymore

Also you can get married in HK and it will be valid under HK law but once you filed for sponsorship, since the guy is a resident of the Philippines, its papers will be processed at Manila VO, thus the complication once MVO requests for the female's AOM it won't show the name of the new husband but the previous one.

Sorry, I beg to disagree, since the new husband is a resident of the Philippines her application to sponsor her common law husband will be handled by Manila VO, therefore the Advisory on Marriage will be coming from Philippine Statistics Authority which will show that she is still married with the previous husband.

Sorry to disagree too...but AOM is for the applicant not the sponsor ...

ahh yes you are right. but the application will still be sent to Manila VO for processing because the common law husband is a resident of the Philippines, now assuming she is a naturalized canadian citizen and her previous citizenship is a Filipino, MVO might require cenomar/AOM from sponsor, don't you think?

Hi Tin,
I'm not a nursing grad so no hepa screening for me. I declined the MMR kasi I'm sure meron na ako noon (although nawala ng mama ko baby book ko) at they don't ask for it sa point of entry. Nung nangulit sila, what I did is I said na sa company doctor ako papa mmr (which is meron naman talaga at 500 pesos lang at re-imbursible pa sa company) ayun di na sila nangulit. Then I always follow up with phone call para ipasa na nila. Hope this helps and goodluck!
