Hi, the refusal was based on the marriage for purpose of going to Canada!! Because I had been before in Canada and got deported!! Please dear how long is the waiting for federal court? Is going to be hearing or just pepper work!? How long I have time to apply?? Please help
That sounds like it might be a tough one to overcome (just an opinion from a layperson, so don't take it to mean anything), depending on the reason for deportation. Was it criminal related, or a case of overstaying your visa? Do you have a case for H & C grounds? I think H & C is hardship or humanitarian and compassionate grounds.

Do a search for judicial review in this forum. It sounds like there is a long road ahead. If you win the judicial review, it goes back into the appeal process before IAD, from the looks of it:

They will assign you an IAD File number if you decide to appeal. The box is marked "For IAD Office use Only" - leave it blank
The sponsor Client ID is the UCI number for the sponsor - should be on the refusal letter.
The Visa office will depend on which city the sponsor lives in. Can't remember, but it could be referring to the IAD office, which would be one of Vancouver, Toronto, or Montreal.
The Visa file number is the Application number, also on your refusal letter.

If you are having problem with this, you may need to hire a lawyer or consultant, as this is the easy part of the appeal process.

I have been gone for quite so long but now i am back with a great news...we won the appeal at last!!! It was such a long legal battle and we finally have proven the merit of our case. Quite few members in here were kinda negative that we will win our appeal case but me and my partner just keep going and being steadfast that we will make it in the end. After we lost the 1st appeal case, we never stopped. We seek for the another legal avenue where we can fight our case. We ended up filling before the Federal Court for leave and judicial review and we won the Federal. So our case was sent back to IAD for re determination and be heard by different member. We had our 2nd appeal case last March 21, 2016, we received the decision last June 4, 2016.

I am so happy the we finally won our appeal. Thank you for all the advice and comments. It made me strong to move forward and go for it. I have a question though, how long will it gonna take before i can finally get the visa? Hope to hear from anyone. :)

Please help me!! I am very happy you made it!! Congratulations!! So i do not know anything about this process!! Please help!! How long is the wait?? So you send them a letter for the Federal Court for leave and they have to accept it and then will be send for a hearing date?? Please help I am so frastrated!!

Yes, you are right. I found a copy of my Notice of Appeal, and I wrote the name of the city where we had the interview.

Yes, leave IAD file number blank.

And be sure you write the Sponsor's UCI number, and not the Applicant's.

Please dear thank you!! I was deported because I had a long road of misrepresentation with CIC!! They think the marriage is not genuine! I do not know if I have the case for H&C. So you think is better to apply for H@C than Federal Court?? Please how long will it be for H&C!!

Do a search for humanitarian compassionate in this forum. See if anything applies to you. e.g. it would separate the children from their mother

Also do a search for relevant case law.

Also to add that I think arguments for humanitarian and compassionate are also made at the federal court. I did a quick search for immigration humanitarian compassionate and it came up with over 17,000 decisions. Look in your inbox.

Yes, the Visa File Number is the Application Number. It is "F000xxxxx" or something like that.

It can be quite confusing. They call it different things on different forms. Sponsor UCI = Sponsor's Client ID; Visa File No. = Application number

Please note that the Sponsor must file the appeal, and not the Applicant.

Yes, only you would know what applies in your particular case. I can see H&C grounds may apply if it would put undue hardship on children involved in your relationship, or if you face persecution in your home country, or something like that.

If you've been deported several times already, it would make your marriage highly suspect. Very hard to prove that it is genuine, I would think.

Sorry .... I misread that. You were only deported once, but had a long road of misrepresentation. How serious was the misrepresentation (s)? If you were deported because of it, I suspect it wasn't just an innocent mistake.

I read in this forum that there is a two-year ban on applying again if you were found guilty of misrepresentation, sometimes up to five. And even after the two years, it will stay on your file forever, and will probably impact future applications for any kind of Visa into Canada.

Hey guys, out of the blue today my Ecas shows a line 6.. Medical results received.

Our appeal went through like early April. In Australia.

What does this mean? Are we almost finished? Med results rec'd would be good news?
We first filed Dec 2011 .... got 2 refusals.
This would be so nice to think its almost over ....
