Hello everyone, I was hoping someone would know if I can sponsor my mom into Canada (once the start accepting applications again) or apply for a supervisa even though she is currently in the united states illegally.

Thanks!

Super visa is a temporary visa so I think it is unlikely that she will get one if she is living in the US illegally. Immigration will feel that if she comes to Canada, she will have no place to go back to because she will probably not be allowed back into the US again and she will probably not want to return to her home country which is probably why she overstayed in the US to begin with. They will think she will overstay in Canada too.

Don't bother with the super visa - I think there's zero chance she will be approved due to her illegal status (to be approved, she must demonstrate ties to her home country and prove she won't overstay her visit - pretty much impossible to do if you're illegal in the country you're in now).

Go ahead and sponsor her for PR once CIC starts accepting applications again early next year. Her illegal status won't be a problem.

Thank you Leon and Scylla for your responses. Everything you have said makes sense (didn't even think about it from that angle)

I appreciate your help. I will do a PR sponsorship once they open it up. Quick question (hoping either one of you know or maybe someone else) Part of the PR sponsorship process includes a lot of certificates (such as police certificates, medical, etc) that are usually done in your country of residency; could she have access to get all the documentation that she needs while in the states? or would there any ''certificate/requirement'' that she would need to do back home (where she is from)

Thanks again, any help is better than none!

Medicals can be done anywhere.

You don't have to be in a country to obtain a police certificate from there. Check the CIC web site, it provides instructions on how to obtain police certificates while outside a country.

Hello:

I am also in same situation as you were. Could you please share your experience?
Did you mother get the PR? I hope you will reply soon

Being illegal in the US is not a reason for refusal.
