Marriage Fraud

Hi, I am a female victim of marriage fraud. I sponsored my spouse to come to Canada but he disappeared in 11 days and moved to another province in communication with his known contacts there. He also assaulted me sexually, physically and mentally. He also had pre-marital sexual relations with other girls and fraudulently married me by misrepresenting himself to be a virgin when he was not.

I had reported the matter to CBSA by submitting tip online but nothing was done and they don't provide any update. This fraudster is moving freely and doing multiple jobs in Canada, greedy enough to earn dollars.

I am writing to know if others who faced similar issue of marriage fraud can provide information - whether you were able to deport him/her and how?

Also, Canadian Police does not have any law or authority to arrest the person on the basis of this marriage scam. When will Canada make such a rule to protect the immigrants from these scammers who take advantage of them and sexually harass them?

Have you considered reporting to the police?

There is a far greater likelihood of IRCC acting if there is an ongoing case of sexual assault.

Failing that, the greatest difficulty is some kind of direct evidence of the marriage fraud itself.

Misrepresenting your sexual history is not a crime unless you purposely infect someone with a communicable disease. Typically the onus is on the sponsor is to ensure they are in a genuine relationship before sponsoring someone or at least before landing. As already pointed out if a crime was committed you should be calling the police not IRCC or CBSA. Marriage fraud is difficult to prove and it could take years to investigate. It is not a crime like in some country. Make sure to keep any evidence to make your case stronger. If he admits that he never intended to stay in your relationship that would be extremely helpful for your case.

Yes, I reported sexual assault to the police which is under review.

But the police is not the one who can deport him and revoke his PR.

If anyone who has experienced marriage fraud like this can respond?

I have all the evidence about marriage fraud but it appears there's no proper legal reform available for action to be taken against the fraudster.

Hiding past sexual misconduct is a serious matter and an important decision criteria for someone to agree on marrying someone. Misrepresentation means your intention is to victimize another person who you can potentially target for sexual assault after marriage. If you are hiding your past sexual misconduct, it means you know that it was wrong and you also know that telling the other person would result in them rejecting you for marriage and sponsorship for Canada. Especially, for a woman, it's her right to know whether the person she is getting married with matches her preference and knowing this could make her determine better if he is the right person for her or not. Because a woman seeking a virgin and loyal spouse like herself would dislike someone who engages in sexual relations with multiple women, and she knows their values won't match and marriage won't be successful and above all, there would be risk of sexual harassment.
