Spousal Sponsorship Background Check Delays, Looking for Advice.

I applied for outland spousal sponsorship for my husband in July 2024. His medical, criminality, and eligibility have all been completed, but his background check has been ongoing since November 2024, with no updates since then. I requested GCMS notes, which confirm he’s undergoing a comprehensive background check. I recently applied for a TRV so he could visit me while we wait, but it was rejected the next day. When I followed up with my MP, they said there’s nothing they can do right now because the background check is handled by a third party, and we need to wait until it's completed. Is it true that the MP can’t do anything at all at this point? Has anyone else experienced this?

MP is telling the truth they can’t do anything.

I have applied in july 2023 and been stuck at security check since april 2024 till now nothing helps only you have to wait .my MP is also calling ircc since october 2024 and all the time he just get same response security review is ongoing application is non routine and no timeline is applicable for this issue

If applications are outside Quebec at the 2-3 year mark you can consider mandamus. Some countries like Pakistan are known to have longer than average processing times.

While this is true, would still consider mandamus - and if a Quebec app, speak to a Quebec-based/experienced lawyer, who should be able to opine on how a mandamus with a federal dept works when the delay may be 'caused' by Quebec govt.

This is - potentially at least - an honest-to-goodness and serious legal / constitutional issue, and it's possible that only the courts could untie this particular Gordian knot.

Read this decision yesterday and if IRCC isn’t freaking out they should be. Assume they must be attempting to appeal this ruling and this time they may actually put in some work because it appears as though they put minimal effort to try to get the JR dismissed. Also a concrete example of why not posting accurate processing times for so long was a bad idea. The processing time experienced was actually fairly average processing for peoples who received protected person status in 2022/23 with an additional ~1 year due to CSS. 1 year in CSS is not long compared to most who require a CSS these days. Still boggles my mind that IRCC refused to post accurate processing times for so long given they were posting accurate data when it came to inventory of cases and backlogs. If this becomes case law IRCC will have to take some sort of action when it comes to H&C and potentially asylum/refugee applications. They will still will likely get sued if they cull H&C programs for example but no what other option would they have?
