Hello everyone,

I need your opinion regarding the last question in the “Background” form under the “Statutory Questions” section:

“Has XXX had any serious disease or physical or mental disorder?”

My situation:

I have HIV (positive test results).

I already declared it during my immigration medical exam.

My question:

Should I answer YES or NO?

Since it is already included in my medical file, I do not want to make any misrepresentation.

For those who were in a similar situation, how did you answer?

Since you have already disclosed your status in your medical exam, answering "NO" on the form could be flagged as misrepresentation (providing conflicting information).
In the explanation box, simply state:
The diagnosis date.
That you are adhering to treatment.
That the details were already provided during your Immigration Medical Exam (IME).
This ensures your written application is consistent with your medical file.
