As already pointed out asylum claimants are very frequently waiting 2-3 years at the moment for a hearing date and given the backlog this will only continue to increase unless there is some sort of significant reform. It is just basic math. I would want to know a realistic time period so I can make decisions about my life.

Yes, there are 'lucky' claimants who may receive their NOD within 7-8 months. This is NOT the standard processing time which, as indicated by @canuck78, could take +2 or even +3 years, considering the 300,000 backlog!!

Some quick math facts:
In 2025, IRB processed/finalized around 80,000 claims, almost 100% increase when compared to claims finalized by IRB in 2023. With 300,000 claims in backlog and provided that IRB can process up to 80,000 claims a year (like in 2025), it will take approximately 4 years to clear the backlog.

"Better safe than sorry".. This could apply somehow to what @canuck78 says here. Take all the above into account for better planning your life here. It is NOT reasonable to expect that your claim will be finalized within 7-8 months. Unfortunately, it could take up to +24 or +30 months.. Be realistic. Plan accordingly.

Yes! You can definitely submit a request to IRB for your refugee application to be considered and processed under the File Review Process (Less Complex) without a hearing. This is officially published on IRB's website. This is a link from IRB's website about this process:

There is a form that should be filled, and there are certain parameters/requirements that should be met for the request to be entertained: Mainly that your identity is confirmed (by passport, ID, etc.), that you, the claimant, believe that your claim is straightforward and not of a complex nature (no criminal background, etc.); you have satisfactory evidence, you come from a country with high approval rating, etc...

If you meet all these requirements, you can fill the form and submit your evidence to IRB. Sometimes, IRB will send an acknowledgement of receipt of the submission. I read somewhere that IRB may accept the request for file review submitted by the claimant provided that the front-end security screening is complete. If FESS is not complete, IRB will advise accordingly, that they cannot process the claim under the file review process due to incomplete FESS.

Therefore, the best course of action will be to ensure first that your FESS is complete. If so, you can fill the form, attach your evidence and submit everything to IRB.

It is ultimately up to IRB to approve this request.

Generally speaking, IRB may initially identify a claim as that it would be possible to be processed under the File Review Process. Upon reviewing all the submission, IRB may indeed be fully satisfied and will accept the claim and send the NOD without a hearing. However, having reviewed the submission, IRB may decide later that there are 1 or 2 specific points that should be investigated further with the claimant and accordingly will request a short hearing (that could last for up to a maximum of 1 hour). IRB could end up requesting a full hearing if the member believes that there are several issues that warrant further investigation..

One more fact: Even if IRB identifies a claim as falling under the File Review Process (Less Complex), this does not automatically warrant that the claim will be processed within 5-6 months. It still can take a long time, a very long time, to process the claim and send the NOD. With the huge backlog (300,000 claims), it may still take +20 months or even more to process the Less Complex cases....

Not really, if you prepared your basis of claim and you have your evidence, you can do it yourself. The form is available online, simply download it, fill it, attach the evidence and submit it to IRB.

It is better of course to wait until IRB identifies your case as being eligible for file review. However, if you FESS is complete and you have not heard from IRB, you can try and submit this request.

My background checks just completed last month. Should I submit this request now myself?

Yeah.. I had retained an immigration consultant (not through legal aid) and yet I had a bad experience. I removed him and continued alone.
I have heard so many stories of this bad experience with immigration consultants and even lawyers.

I tell everyone, in light of my experience, that this is your life. Immigration consultants/lawyers are settled. They have tens of cases and they have dealt with hundreds or thousands of cases. Your case is just a number for them. However, this is YOUR life and that of your children (if you have). This is YOUR fight. You have to advocate for yourself. If you wait for 1 or 5 years, this is NOT their problem. It is YOURS. They have their life going on, while your life is not moving on..

Weather or not you remove her, it is up to you. If you think that you can continue without a representative (like I did).. then do it. Otherwise, if you think that you need a representative, search for a good one, even if it will cost more..

Even if you are your own representative or even a very strong lawyer, agencies like Immigration, IRCC and IRB operate on their timelines, not yours or your representative’s.
