Hi everyone,

wondering if a person can get their passport back after a positive NOD and before PR to use it for travel to a third country that doesn't issue visas on RTDs?

any information would be an asset to me

No. You won't be able to get your passport back until PR.

You shouldn’t be using your home country passport to travel if you want to retain your status in Canada. You need to use an RTD.

Would add that if the country you wish to visit doesn’t accept your RTD so you use your home country passport instead that shows you were aware of what you were doing. That weakens your case if the gvt tries to take away your protected person status in Canada. Pick a 3rd country where you can travel on your RTD.

You can get your passport back after NOD and before becoming PR. Only travelling to your home country will revoke your refugee status. Travelling to other countries using your country passport will not affect your status in Canada.

This individual used their passport to travel to their COP. To the best of my knowledge, we have yet to see a case where passport renewal and using that passport to travel to counties other than the COP resulted in cessation. Cessation cases have consistently involved travel to the COP.

well we are from a war torn country and our families fled to other countries which doesn't accept RTD, and incase you need to visit a family member for an emergency it means that's not allowed :') thanks for the information

have you or do you know someone who asked for their passports and they got them without a hassle? and did they face any issues when entering Canada again? as I mentioned to the other person above we are from a war-torn country and our families fled to other countries which doesn't accept RTD
 
I see some people say that they asked for their passports before PR and they got them, so I am a bit confused
I'm not aware this is possible but quite possible I may be wrong about this. I know it's possible to ask for photocopies of your passport.

This very recent JR actually does mention that using your home country passport would be enough to lose status. In this case both used their home country passport to travel to their home country and neighbouring country. Unclear whether if person had only traveled to a 3rd country would have been enough but still a huge risk.

Would be speaking to a lawyer about the risks of using your home county passport and what reasons for travel/length of travel may be considered an exceptional circumstance. Being a protected person or refugee comes with a lot of benefits but also comes with limitations including not being able to travel to certain countries. Canada is taking a much harder enforcement stance than they have in the past and gambling with your status in Canada until you get Canadian citizenship is extremely risky.

This individual travelled to his country of origin China and that is why refugee status was revoked. The information I posted are correct. You can refer to IRB website on this case and similar cases.

Asking for photocopies is possible before refugee claim is decided. After NOD, protected person can ask for his passport back.
