Thanks so much for you guys always helping.

My question is regarding the “declare” tax section in IMM 5409.
For question d on IMM 5409 (“Have declared our common-law union under the Canadian Income Tax Act (T1 General – Individual Income Tax Return)”), if we only became common-law this month and updated our marital status on CRA MyAccount today, but our most recent T1 tax return was filed as single, should we select “Yes” or “No”?

The important question is:
When did you actually become Common-Law?
It will be the one year anniversary date after you had been cohabiting under the same roof, living as romantic partners, not roommates.

If that date was after your 2025 return, you will answer no.
