You can attempt to extend your visitor record (as it appears you may have done not your TRV) but that is far from guaranteed. If denied your options are to remain in Canada without status or to leave Canada. H&C applications do not prevent removal. Your H&C chance of success will be severely impacted by both the fact that you applied as visitors and then left Canada soon after applying for H&C.

You should have a plan b especially given the fact that you left Canada right after claiming h&C. You got lucky your TRV wasn’t cancelled and you were let back into Canada. Hopefully you purchased emergency travel medical insurance.

Yes I do purchased emergency travel medical insurance.
I had to return to my home country for approximately 10 months to settle an urgent property matter, as a tenant was not vacating the premises and had absconded. This required my personal presence and could not be postponed.

I returned to Canada on 5 October 2024 and have been residing here continuously. I also applied for a visitor record extension to maintain legal status while awaiting a decision on my H&C application.

Key humanitarian and compassionate factors:

• Daughter’s Best Interests: Requires ongoing medical care only available in Canada.
• Family Support: Son is a Permanent Resident employed full-time, providing stability.
• Age and Personal Circumstances: Relocating would cause significant hardship.
• Responsible Compliance: Applied for a visitor record extension in time to maintain status.

I hope this unavoidable absence be considered in light of these ongoing factors.

How old is your daughter and what is her status in Canada? It also appears as though you were away from your daughter for that period of time so she was not dependent on your care. There is a specific parent sponsorship program for parent sponsorship although parent sponsorship is never guaranteed which you should face planned for when your son immigrated to Canada. You also have access to the supervisa program. Not IRCC but other than potentially your daughter these are not strong grounds for H&C. People are being misinformed that H&C is a way to circumvent PGP and many are going to end up having to return home and struggling to visit because of the H&C refusal.

Does anyone have link or access to statistics for H&C claims? I can't narrow it down on open portal or stats can.

The revised targets which govt has is not enough as this program has become one of the most abused just like the asylum. It needs to be shut down for good.

Have looked in the past and can’t find any updated numbers regarding H&C. Would also love to know the breakdown in quota allocation between the H&C programs.
