Hi everyone,

My work permit expired in Nov 2024. I applied for OINP (Foreign Worker stream) and a work permit extension in Oct 2024, which gave me implied status until Mar 2025. The extension was refused, so I lost status.

I also applied for Express Entry in March 2025, but that PR application was refused in July 2025. Around the same time, I asked my employer again about supporting me with an LMIA, but they said no and asked me to resign.

Since OINP is job-offer based, I’m worried my application will be refused without employer support.

Has anyone been in a similar situation? Should I apply for restoration as a visitor while I figure things out, or focus on finding a new employer quickly? Any advice would mean a lot.

Thanks in advance for any advice you can give.

- Yes, your application will be refused without employer support.
- When did you lose status? When was the work permit extension refused?

My work permit extension was refused in March, so I applied for a restoration with a Bridging Open Work Permit (BOWP), since I still had a PR application in process at that time. However, the approval of that BOWP was depended on the outcome of my PR application.

How were you eligible for BOWP? You needed work support letter from Ontario to extend permit (closed) to work for employer. Don't believe you can restore status as your WP was refused in March.

The BOWP application is going to be refused since your PR application was refused. At this point it's too late for you to apply to restore your status again. You need to leave Canada to fix your status.

He recently received an invitation under the OINP Employer Job Offer (foreign worker) stream. At the time of submitting the EOI, he had claimed points based on CELPIP results showing CLB 7. However, those language results had already crossed the 2-year validity period before the invitation was issued. Unlike Express Entry, the OINP EOI profile did not automatically adjust or remove the language points after expiry, and his score continued to reflect 63 points on the date of invitation.

Before receiving the invitation, he had reappeared for the CELPIP test, but one module was at CLB 6. Subsequently, after receiving the invitation, he retook the CELPIP again and has now obtained CLB 8.

His employer has completed their part of the process and had advised him to retake the language test, which he has successfully done.

We would appreciate guidance on how this situation should be properly explained and documented while submitting the OINP application, particularly regarding the expired language test that was originally used in the EOI and the updated valid language results now available.

Would he have been selected with the lower language score?
