My wife was in SOWP lost her status and we applied for restoration of status as visitor
We got the approval letter ,but there was no request to send passport for TRV stamp

"" Your application to remain in Canada as a temporary resident has been approved. A secure document has been mailed to you at the address that you provided when you made your application. If you have not received your secure document within six weeks, . contact IRCC Please note that as per the Immigration and Refugee Protection Regulations (IRPR), a valid medical examination is required if you are seeking to work in certain occupations in which the protection of public health is essential. Please review the following page to find out more about such occupations: Medical exams for visitors, students and workers countries If you do not have valid medical results you may have received condition 15 or 16 printed on your permit stating “Not authorized to work in 1) child care, 2) primary or secondary school teaching, 3) health services field occupations (condition 15), 4) agricultural occupations (condition 16)”. If you wish to remove these conditions on your Permit, you will need to complete a medical examination and then, you must submit a new application. You also need a valid medical exam if you are coming to Canada for more than 6 months and you lived in one or more of these for at least 6 months in a row within the last year. ""

How can we get the TRV stamp from inside Canada before she travel out side Canada ?

Don't think she didn't apply for a TRV. She applied for a visitor record to remain in Canada, correct? If she lost her status, she cannot apply for a TRV from inside Canada. So did she apply for TRV before she lost her status or not.

Yes correct visitor record, her TRV has expired in the same day as the permit which was August 2024
And then we applied to restoration of status as visitor
But when I asked the lawyer he said it's a visitor record and I have to send the approval letter with passport to get TRV stamp
So what the visitor record means in this case and how do I get the TRV stamp as she need to travel urgently

A VR is just to maintain status in Canada. VR is NOT a TRV. Once she leaves Canada her VR is cancelled because no longer needed. She cannot apply for a TRV or get it stamped from within Canada. So one she leaves she applies outside Canada.

So there's no any option to get the TRV from inside Canada even if i apply for visitor visa within Canada and attach the visitor record with the requirements?

No. You must have valid status as a student or worker to apply for TRV from within Canada. Your licensed immigration lawyer should know this.

One last question: can she apply for visitor visa from out side Canada while she still her in Canada and once she get approved she can leave and get the TRV stamp from out side canada?

Ok, what the percentage of getting her visitor visa approved from out side Canada if iam holding work permit for almost 4 years now and i have 8 month child ( born in canada ) still in need for care inside Canada so they have to come back together ? Any idea

There is no way to know that information unless you do an access to information request. Having a Canadian child is no benefit. In fact, it shows that you will not return to home country. If you have a valid work permit then you can apply inside Canada so why apply outland. When does your WP expire?

If she didn’t apply to extend her SOWP I assume she doesn’t qualify for one. She is not a visitor which is one of the issues it appears as though she wants to live in Canada. She should either qualify for an SOWP or there is a good chance she will not be able to return to Canada as a visitor in the near future. Do you have a realistic pathway to PR? Do you have an ITA? She may not be able to extend her visitor record even if she remains in Canada when she applies next time because she isn’t visiting Canada.

That's a surprise and big shock for me , even if i renewed my work permit we will not be able to extend her visitor record as well ?

My big fear if she left the country she will not be able to be back as visitor as she is not qualified for SOWP.

I applied for OINP program foreign worker with job offer - material handler with the new portal, still waiting for invitation?

Any suggestions or recommendations?

She can extend her VR to remain in Canada. At some point it can be refused. Having spouse who is working and Canadian child doesn't make an automatic approval. Make sure she shows a lot of funds.

If she doesn't have a TRV she applies outside Canada and it could be refused. She needs to show ties to return to home country and cash in the bank. All her family ties are in Canada so chances of refusal are high.

You are in a non EE stream and you are years away from PR even if invited tomorrow. When does your permit expire?
