Hello ,
I have applied for OWP -V in June , as my employer did not paid me my dues of April and all of sudden he closes his business and filed for bankruptcy,
I’m on close work permit and I’m here with my family including 2 kids to feed .
But as I’m on close work permit I can’t work anywhere else and it’s been very tough situation for me ,
Now my close work permit is going to expired in Sep.
I would like to know can my spouse and my kids can stay with me if my vulnerable open work permit approves .
And what are the chances of getting it approved.

All help appreciated

What type of permits are they on? Usually the VOWP is given for one year or up until closed work permit expiry. VOWP takes months for processing and closing business may not be a reason. It is for abuse (see link).

Your permit needs to be longer than 16 months for spouse and kids to keep their permits.

And if your permit is going to expire next month, can’t see them giving you a year

Plus as mentioned, it’s not abuse

If your permit was expiring in September you should have already had a PR application or other WP being processed if you were trying to remain in Canada. As others have pointed out an employer going bankrupt and closing is not typically grounds for VOWP. Your family should be returning home if you are short on funds, their status will be expiring in September, etc.

You are a temporary worker on a closed work permit.
The business that hired you closed down. You need to return home since there is no more work under that employer for you any more (meaning of a close work permit).
I don't see any ground for vulnerable work permit. You were not abused at the work place and asked to continue to work under an abusive condition.

Abuse I mentioned in my post is that I was not get paid for my sevices and the cheque I was given by my employer was returned by my bank .

Read the link. How long were you not paid? Did you go to the Labour Board and file a complaint? Have you filed a complaint with EDSC? Your permit expires in September so why would IRCC give you another year.

Not really financial abuse. Business was likely out of funds which is why you didn’t get paid for the last month. Employer should have let you go a month earlier but was likely trying to salvage their business and thought they would be able to pay you even if they were late. This was not a longterm pattern of not paying you for your work but sadly a very common issue right before a business goes bankrupt and closes.

So basically you are saying if any kind of abuse will not be considered abuse if it does not fit in time frame for example if it does not occur before a year IRCC will not pay any heeds .

You have a LMIA so should be making a complaint to EDSC now. Employer closed the office so not operating so that isn't abuse. Seems like employer was going bankrupt and not paying anyone which is not abuse. If you feel it is then contact EDSC and also make a complaint with the provincial Labour Board. Once you have filed your complaints, file for VOWP and see what happens. If refused you will be out of status immediately. You cannot work until a response which will be 5-6 months unless they feel your case should be expedited.

Also you need approval first if you have spouse and children. Then you need an eligible NOC for their permits to be approved.

Adding if your work permit was going to expire in September, and it was closed , you should of already been starting to wrap things up here in Canada , since it was always temporary in nature
