Are points locked in when receiving the ITA?

I was prematurely awarded points for my second year of experience by the system as it only counts months and not days. By my application, I'd be 16 days short.

My score without the extra year is 517, one below the cutoff, 518.

Can I take the French exam, and increase my points that way? That way, even if my second year is not considered, I'd be above the cutoff if I score 2 points.

Or is there no way to make up those points?

Just wait until you have the full two years of experience before you submit your application and you'll be fine.

Problem is... I won't have them even by waiting. I'll be 16 days short.

I contacted the IRCC client Centre and they sent me this by email:

Invitation to apply - How IRCC calculates the one year work experience

When submitting an Express Entry (EE) permanent residence application, you must demonstrate you are meeting the eligibility requirements of one of the federal economic immigration programs. One of the requirements is to enter the month/year of work experience and no specific date. Therefore, you may have received an Invitation to Apply (ITA) even if you are missing a few days of work experience to be eligible.

IRCC officers processing the EE applications are aware of the system calculating months and not actual days/hours worked in a month. When reviewing an application, they will take into consideration factors such as:

Continuous work status,
The Offer of Employment Letter from the same employer, and
Whether you reach the one year work experience at the time the EE application is submitted/approved or within a few days after.
The decision for approval is at the discretion of the officer. However, the onus is on you to provide all required information and supporting documentation to facilitate the decision.

I feel like the text above suggests I should be fine, but doesn't really commit to making statements.

Thoughts?

This is a boilerplate response and you can't determine if you are OK or not based on this. IRCC does not give advice on individual cases. You need a lawyer for that.

Email response doesn't say that you are okay. You need to meet calendar and work hours. If you are 16 days short, you need a lawyer.

Are you sure that you will be 16 days short even after waiting for the entire 59 days? I haven't seen IRCC make this mistake yet.

I swear I'll pay you a lawyer fee if you figure this out, because I haven't seen many in my situation.

Problem is...

I had two jobs.
One from 31 - May - 2022 to 25 - July - 2023 (13 months and 25 days). System counts this as 15 months (?)

Another from 19 November 2024 - 7 September 2025 (ongoing, but that's my deadline to submit. That's 9 months and ~18 days). System counts this as 10 months.

Total by deadline is 23 months and ~13 days.
