When I was 16 in august 5th 2017, my entire family left Canada and to djibouti is where we left to. my mother had only stayed with us for 6 months and left with my other brother back to canada. my mother and 2 of my other brothers have remained their residency status but i didnt. We came to Canada in 2009 because we were refugees escaping a civil war in Somalia thus we had seeked asylum and gained status as refugees in 2009. I lived in Canada from June 2009 to August 5th, 2017. I went to elementary school, middle school, and high school there. But since 2017, I haven't lived in Canada anymore. My permanent resident status, which I got in June 2016, expired around 2020 or 2021. I am not sure entirely. My main issue is that i havent remained my status and do not meet the residency obligation anymore as it has been almost 5 years since i havent lived in canada.

Because I was a minor, I didn't understand much about my legal status or how to take care of things on my own. I've been living outside of Canada for almost 5 years now. Even though I see myself as someone with permanent resident status in Canada and I want to go back, I couldn't do it because I was young and didn't have the resources.

Currently, my mom and two of my brothers live in Canada, I really want to return to Canada and live there. I don't meet the residency requirement anymore, but I think I could still have a chance to go back under humanitarian and compassionate grounds. I've spent a significant part of my life in Canada, have family and friends there, but unfortunately, I couldn't complete my residency requirement because I had to leave as a minor against my will.

My question is, can I return to Canada, and what kind of help can I get? I have the time and resources to go back.

This is a volunteer forum so answers take time. Since your PR expired, you will need to apply for a PRTD. Can’t say if it will be refused or approved. Did you return to the country you claimed asylum from? If so that may be taken into consideration. Your family returned and felt safe to return and live.

Or if you have a US visa, cross at a land border. Do you have a SIN card?

If your mother and brother maintained residency then why did you not? You say you were taken against your will but your family members have maintained residency.

Applying for PRTD is your only option then. You apply from PRTD when your PR card has expired. Do you have any documentation - passport, expired PR card. You need documentation to apply. Given your situation, I would hire a Canadian immigration lawyer to do this for you. It will cost a lot of money but it will be done properly. However this probably is not an option for you.

Is hiring a lawyer my only option? i don’t mind how much i have to pay because myself and friends back in Canada are invested in this situation to bring me back as I am in dire need to do so. I only see that there is no real way of returning to Canada if applying for a PRTD is the only option, only way it can get approved is with a valid PR.

PRTD is for people who have expired PR. That is the whole point of a PRTD those who don’t have valid PR. If you have a valid PR, you could travel to Canada now. You may have a case for H&C grounds. If you and friends can pay a lawyer then suggest you do. It may be up to $10,000 (may be more).

PRTD with H&C is your only option. Processing can take time, yes. Can’t comment on length but you cannot enter Canada until PRTD is approved so yes, it could be many months. You really need a lawyer as this is a complicated case, and don’t think you have a passport or any documentation.

Your only option is to apply for a PRTD with H&C considerations and indicate that you were removed from Canada as a minor.

You can do this yourself or with a lawyer.

You cannot apply for PR under H&C. To apply for PR under H&C, you must physically be in Canada and also not a PR.
