I'm currently putting together my documents for myself and my boyfriend for my EE profile.
We've been dating for years and we want to make it official, especially for him to enter as a partner in my profile on EE.

My question is: Married x Common law? Which one is better for application? Since we still don't live together.. We don't have any bills, no lease or mortgage together.
For both options we should have at least 12 months proof?
Are any of the options relatively easier in this situation?
What could be used as evidence?

*We would like to open the profile soon and immigrate next year.

Any help would be appreciated!!

Common law = you have lived together continuously for at least one full year and have evidence to provde it

Married = legally married. No need to live together for 12 months.

There are no other options for being part of the same application. Just the above two.

If you 2 didn't live together for 12 months, your only option is to get married.

You don't need the one year of cohabiting proof if you get married. Since you have not yet lived together at all...you do not qualify as common law.

Hi MariaEM,

It's great to hear that you're working on your Express Entry profile! When it comes to deciding between marriage and common-law partnership for your application, there are some key differences and requirements you should be aware of.

For a common-law partnership, you and your partner must have been living together in a conjugal relationship for at least 12 continuous months. Since you mentioned that you're not currently living together, a common-law partnership may not be the best option for you. If you choose to go this route, you'll need to provide proof of cohabitation, such as a lease agreement, mortgage documents, or joint bills.

On the other hand, if you decide to get married, you won't need to show proof of cohabitation for a specific period. However, you will need to provide a marriage certificate and other supporting documents to demonstrate the genuineness of your relationship. Examples of such evidence include photos together, correspondence, travel documents showing trips taken together, and statements from friends or family who can attest to the authenticity of your relationship.

Given your current situation, getting married might be the more feasible option for your application. However, please note that both options require you to provide sufficient evidence to demonstrate that your relationship is genuine and not just for immigration purposes.
I hope this information helps you in making an informed decision.

Best of luck with your application!

Since you mentioned that you're not currently living together, a common-law partnership may not be the best option for you.
It is not even an option, since the OP would like to "open the profile soon and immigrate next year."
