Hi All,
I am falling short on my RO by around 4 months or so. I am already in Canada since last year and do not intend to travel outside for the next couple of years. My initial 5 year PR period ends in Oct 2023 (PR card expires Jan 2024). Should I
1. Apply for renewal before October 2023 or
2. Wait till Jan/Feb 2024 when I will be completing 730 days in the last 5 years and then apply for PR renewal ?

When PR is applied for renewal, is the 730 days counted from when the PR was first granted or is it counted from when the PR renewal application is submitted/ worked on ?

Thanks

Definitely #2. The five year period will be the previous five years from the date you apply.

@scylla Thank you for your response. In the interim I am planning to apply for family sponsorship for my family who are already here on Visitor Visa. Will applying for family sponsorship trigger a RO check on my PR ?
I will have to apply for their Visitor Visa extension shortly irrespective.

Thanks

Yes applying for family sponsorship can trigger review of your RO so always safest to wait until you are compliant. Looks like you were working in the US before moving to Canada so you could have moved to Canada a few months earlier to be compliant with your RO.

Wait until you meet RO before you apply for family sponsorship.

Yes I did plan (have documents to support that) to move from US to Canada in July 2021 once the land borders were open for travel (July 6 2021) and after my full vaccination but had to abandon and abruptly (2 days before crossover) fly back to home country to take care of sick parent, I got stuck in home country for close to 6 months. As soon as it was feasible again, I flew back to Canada.

In this situation is my safe option to extend my family's visitor visa multiple times until I am back in RO and have my PR renewed ?

Thanks for the guidance/ insights.

You don't have to wait until your PR card has been renewed to sponsor your family. However you do want to wait until you are sure you are back in compliance with RO before you submit the application.

Unfortunately we see this all the time. When people don’t leave any buffer time and an emergency situation occurs then the person fails to meet their RO. People really should give themselves at least a 6 months buffer because emergencies happen.

Thanks for the insights of everyone who replied. I went with the option to apply for family sponsorship, though there being a risk of triggering a RO review. This was for some personal factors which were deliberated before making this decision.

Since my family is in Canada on Visitor Visa and their 6 month stay clocks out by April end, would the recommendation be to apply visitor visa extension closer to mid April and hope to get an AOR for Spousal sponsorship by mid April which will enable them to continue to stay in Canada until decision on their PR application? Or is it safer to apply for Visitor Visa extension by end of March and hopefully get their visitor stay extension approved for whatever duration CIC grants and by then the PR AOR might come through ?

Thanks

I don't see the point of replying... anyway....

regardless of sponsorship, you should apply to extend their stay before their 6 months visitor status expires.

AOR of sponsorship application DO NOT give them any status. Not even implied or maintanence. (if someone told you that, you should disregard the rest of the information this person provided)

YIKES! Your`personal factors' must be important to you, to trump the excellent advice from @scylla to wait until you had met the R.O. to apply to sponsor, but...good luck!

I had the information that AOR on PR application allows them to continue to stay in Canada on current status until decision on PR is made by CIC.

Is the recommendation to apply for Visitor Visa renewal closer to the stay expiry or as soon as possible ?
Secondly can anyone help with guidance on whether we should apply for extension of 6 months or more (1 year) ? Meaning does 2nd option gets looked at unfavorably by CIC or will they consider 1 year extension as a reasonable request with the PR application being in process.

Thanks

Definitely not true. If they lose their status during the application process, and do not apply to extend their status, they no longer have legal status in Canada. After 90 days without status, they can no longer apply to restore their previous status.

They should apply to extend their status close to when it expires. A submitted application to extend does give Maintained Status until IRCC responds to the request.
