Are you on an open work permit?

If you are on an open work permit and want to claim the 50 job offer points under EE, then yes, employer needs to obain an approved LMIA.

In most cases, your employer needs a Labour Market Impact Assessment (LMIA) to support your job offer for Express Entry. Some jobs do not need an LMIA.

Your employer doesn’t need an LMIA to support your job offer if:

  • you have been working full-time for the employer on your work permit for at least 1 year(or an equal amount of part-time work)
  • you have a valid job offer, and
  • you have a valid work permit that is exempt from an LMIA under:
    • an international agreement
    • a federal-provincial agreement
    • the “Canadian interests” category
That’s what it says on the official website

Again, what kind of work permit are you on?

This is not the full list of requirements.

This rule only applies to individuals on closed work permits (e.g. ICTs). If you are on a PGWP or SOWP or other open work permit, the employer needs to obtian an approved LMIA.

Yes I am on PGWP, so I’ll have to work for another year after being approved for LMIA?

No, you don't need to work another year to be approved for an LMIA.

It means that if you want to claim the 50 job offer points through Express Entry, your employer needs to obtain an approved LMIA. Your employer can apply for the LMIA at any time. They don't need to wait until you've worked for them for a year.

Alright what if my employer has already been approved for an LMIA and one of the employee is presented with that LMIA, will They have to apply for a fresh LMIA or I can work on the same one?

New LMIA is needed with your name on it.

Does "you have been working full-time for the employer on your work permit for at least 1 year" refer to an employer mentioned on our work permit (that is, when on a closed work permit)?

I am on a PGWP (Open Work Permit) and have 1 year of NOC B experience. Since there was no LMIA issued, I believe my job offer is not considered valid and eventually, I am not entitled for the 50 points right? (Even though I get Canadian Experience points and eligible for CEC)

You aren’t eligible for 50 points on PGWP. You need a LMIA.

You are only entitled to the 50 points if your employer gets an approved LMIA.
