I am currently on a visitor record which is expiring on March 1st. My employer has applied for a LMIA at the start of January for a NOC in Agri Food.
My goal is to apply for a work permit if I get the LMIA before my visitor record expires.
My questions are:
1. What are my options if I don’t get a decision on LMIA before March 01?
2. Can I apply for Visitor record extension and during that apply for work permit while I am on a maintained( implied) status?
3. I heard that ESDC was giving priority to some specific NOCs (care givers, health sector and Agri food) and processing their LMIAs faster. Does that still apply until right now?
4. What would be my options if my visitor record extension is refused? Would I have to leave Canada or can I apply for restoration of status + work permit? Or is restoration only going to be for the visitor record?
5. Is there any possibility I can flagpole for the work permit if LMIA is positive? I don’t have a valid trv.
