a cousin of mine migrated to canada over a two years now, left UAE with unpaid personal loan and credit cards. He is assuming that he has a civil/criminal case filed againsts him emanating from issuance of cheques and defaulting payments of credit card.

Will this affect his PR status in Canada? and if ever he will apply for citizenship will this be a reason for rejection and possible removal to Canada? BTW they have two canadian born children.

Please explain.

Thanks

The only way I see that can affect him is if he was asked to provide a police certificate from UAE....in this case he may be in trouble...
Otherwise I think this has nothing to do with PR or citizenship.

If its a civil case: No. If its a criminal case: maybe. It depends on whether the circumstances would have been criminal in Canada.

Get a lawyer's advice on this though. Your cousin may be able make an assignment in bankruptcy in Canada and if he/she gets a discharge the debt would be unenforceable in Canada. Once again, get a lawyer.
