TFW applied for SINP and work permit expire soon

Hi Experts,

Whenever trouble comes we always discuss to our nears/dears and expertise to face and find out the resolution.

Today, i am also in the same situation when i need help. I am in canada and here is my status details. Applied for SINP OID(NOC = 2171), Submitted - 4th Oct 2016, waiting for applicant - 1st Nov, "In-Process" - 4th Nov 2016. and still status is showing "In-Process".

My current work permit will expire soon and employer said that can't extend because cumulative duration of work permit greater than 4 years. I am woried because spouse is expected (5 months) and she couldn't able to travel due to some complication as per doctor instruction. My first priority is my family and i don't understand that what should i do now?

Could you please help me that what are the ways to come out from this situation? Your advise highly appreciated.............

did you worked the full 4 years??
if not ie. unemployment does not count as work and CIC will give you the rest of the 4 years

Isn't there an exemption to 4-year rule if you are in NOC 0 or A.

You can try and ask SINP to speed up your application if possible. Call Tracy Davies and explain to her your situation. She is the manager at SINP and she is really helpful at most times.

And if you have gotten your nomination before your work permit expires or maybe after, you can still try and get a closed wp based on your nomination.

See below:

When you work within one of the occupations or categories listed below, the time you work in Canada is still counted toward your four-year maximum.

It is only when you apply for a work permit that these exceptions become relevant. An officer may issue a work permit to you if you have a job offer in one of these occupations/categories, even if you have already worked in Canada for four years.

These categories or occupations are the exceptions for which a work permit can exceed the four-year limit:
•NOC O and A (including spouses/dependants of these skilled temporary foreign workers)
•LMIA-exempt jobs under ◦International agreements
◦Canadian interests
◦Self-support
◦Humanitarian reasons

•Jobs that do not need a work permit
•Permanent resident applicants who have received a positive selection decision or approval in principle
Provincial nominees applying for an employer-specific work permit

Any work done while studying in Canada on a full-time basis does not count towards your four-year maximum.
