Hi

I would be grateful for a solution to my query regarding residency obligation.

My three years outside Canada will expire in November this year (2014).. However due to some personal reasons I need to stay outside Canada for another 5-6 months. My wife and two kids have already established residence in Canada (Ontario) and I too intend to join them permanently in and around May 2015.

I need to know how much will it impact my PR when I return for good in 2015?

If you don't meet the RO (residency obligation) and the immigration officers become aware of that when you enter, they will give you a hard time and could possibly report you.

If they report you, you can either accept the loss of your PR or appeal.

If you appeal, you keep your PR status and can stay in Canada during the appeal processing time. However, if you do not have good grounds to appeal with humanitarian grounds for why you were unable to meet the RO, you will likely lose your appeal.

If you do, you would lose your PR and be asked to leave Canada. Your wife, as long as she is a PR and still meets the RO and is residing in Canada, can sponsor you back.
