Hello all,

I am a Canadian citizen living in Canada, married to an American citizen (who is currently visiting in Canada, and eager to permanently relocate and work). We have two young sons, ages 5 years and 8 mos, both Canadian citizens born and living with us in Canada.

We are submitting an outland PR application with me as his sponsor. My question is, do I have to meet a certain income requirement to sponsor him?

I have never collected social assistance and have consistently earned enough income as a self-employed consultant for the past 12 years, and continually employed my entire adult life prior to that.

Is my income level a criteria in deciding if I can sponsor my husband? If so, how much would I need to earn given we have two dependent children?

My husband also obtained a letter of intent from an employer in Canada offering him a job if his PR application is approved. This job will pay him enough for our family to be quite comfortable. Will this be considered if my income is not high enough?

Hi

There is no minimum income required to sponsor a spouse. You just have to show CIC that you can support yourselves without welfare.

I thought there may be an income requirement because on the Sponsor Evaluation form (IMM5481E), question 3 asks for personal income for preceding 12 months before application.

So the spousal sponsor's income level is not considered? They won't reject a spousal sponsor based on income?

Yes, they do ask but there is no minimum amount. CIC will look at your situation as a whole, i.e. your income, your spouse's income, savings, investments, family assistance, income potential in the future etc.

Don't stress, you'll be fine.

i hate to be the bearer of bad news, and i might be wrong, but unless your husband's potential employer is willing to wait 7-8 months or more, your husband will likely need to look for another job once his papers come in. there should be a thread on the board for American outland applications - you'll be able to get a feel for how long the application processing takes. another option to look into is applying inland if your husband qualifies for an open work permit while the application is being processed.

but good news - there is no minimum income required to sponsor your spouse :D

He might be right though.I just caught it from your reference.It simply says that Paragraphe 1 doesn't apply.did you read paragraph one of this link you posted?They simply said that the sponsor will not be in obligation to reimburse welfare assistance.lolll.

Financial test - sponsor

CPC-M will indicate where applicable whether or not the financial test is met. This is determined
by taking into account the number of persons in Canada for whom the sponsor is responsible,
including persons who are the subject of another undertaking signed or co-signed by the sponsor,
and the number of persons included on the sponsorship undertaking, including non-accompanying
family members. There are exceptions to the requirement for a sponsor to meet the minimum
necessary income test. See R133(4).

It very clearly states that when sponsoring a spouse, the app is exempt from Paragraph 1(j), which covers the income requirement for sponsorship.

Paragraph 1(j):

(j) if the sponsor resides

(i) in a province other than a province referred to in paragraph 131(b),

(A) has a total income that is at least equal to the minimum necessary income, if the sponsorship application was filed in respect of a foreign national other than a foreign national referred to in clause (B), or

(B) has a total income that is at least equal to the minimum necessary income, plus 30%, for each of the three consecutive taxation years immediately preceding the date of filing of the sponsorship application, if the sponsorship application was filed in respect of a foreign national who is

(I) the sponsor’s mother or father,

(II) the mother or father of the sponsor’s mother or father, or

I can say, from very recent personal experience (COPR received less than a month ago), that I do not meet the financial requirements listed in this table, and my application went through without a hitch. not even a mention of it in our case notes.

This information is geared toward OTHER immigration streams, not spousal. The only family stream where you would need to meet income requirements are if you are sponsoring your parents or grandparents for immigration.

To sponsor your husband or your wife has no income requirements.
