Ok I'm the totally wrnog place i know, but couldnt find any ther forum to ask this- We are Canadian citizens, living abroad and we are getting divorced and I'm moving back to Canada with the kids. My husband will stay out of the country.
If he pays child support to us in Canada does he need to file income tax with Canada? And then do I need to include child support in my income in Canada?-we haven't been filing income tax for years as we have been non-residents for a long time and had no ties to Canada.

From my years as a non resident, my tax specialist advised that one of the determining factors CRA uses in determining non resident status is family in Canada. It’s likely your ex will loose his non resident status with your kids being in Canada and will have to report his foreign income. You will have to report any support payments. Best to consulate a tax specialist qualified in these matters for an accurate assessment. CRA has indicated they intend to crack down on no resident status lately.
