Hi guys,

I really need help now. :(:(

My husband and I were nominated by Saskatchewan last year and on 2018 Jan 12th we went to POE to apply and get ours Work Permits. My husband has a Closed Work Permit (he is the principal applicant) and I have an Open Work Permit. So long, okay.

This week his employer talked to us about declaring/filling bankruptcy.
Probably we will need to look for another job for my husband and we don't know what to do.

At first, we needed the Provincial Nominee to apply for the Work Permit. If we are going to change the employer do we need to start a new provincial nominee? Because without the nomination we can't apply for a Work Permit (because we are LMIA exempts - T13 Provincial Nominees), right?

What should we do now? Help help help :(:(:(

You will need to look for a another employer to support your SINP. Since its not your fault that your employer is wanting to file for bankruptcy, SINP will probably give your husband time to look for a employer and file a amendment to your SINP nomination. After you have amended your SINP with the new employer, you can apply for a different close work permit with the same process as you did last time.

You maybe don't need to redo your SINP again but it really depends from SINP point of view. But talking to SINP is a start and also looking for a new job as well.

You will be given 45 days to revise your nomination and you will have to do from yhe first step such as job appoval letter. All you have to do is find a employer who has already been registered by SK government as a SINP registered employer. Once your nomination is revised, your update information of nomination will be transferred to CIC and you might have to provide a revised nomination certificate to CIC.
Here below is some information from SK immigration officer about revision of nomination.
-----------------------------------------------
If you change your job you must notify us immediately; your previous employer is also obligated to inform our office that you are no longer working for them. Once the SINP has received notification that you are no longer working for your employer, you will be sent a letter and must provide a copy of a new offer of employment from a Saskatchewan employer and proof of employer's online registration to the SINP within 45 days of the date on the letter.

There is not website that shows which company is registered with SINP. If your husband new employer is not registered with SINP, then the company will have to be registered with SINP first before they can file a SINP job approval letter for your husband. He will then submit the new job approval form to his current SINP application to revise the old job approval form.

Registering a company with SINP maybe take 2 to 4 weeks if the company is keeping track with SINP like emailing them about the process or submitting all information to them on time

Well, you need to ask first when you look for a job and do interview with your future employer.

What did SINP say?
I call them and they said that I would have 45 days to find a new sponsor. And I asked: What if I don't find? And the lady said I can ask for a kind of extension for the days to keep looking (and could be recused), but we are having though time to find a sponsor.

I emailed them too and I just received an answer that I should communicate if my husband change his job and they didn't give me any deadline.

I read a lot about it and I found: we can stay as long as our work permit is valid and my husband will have to find another sponsor vs we are gonna have 45 days and we can lose our nomination or we can be invited to leave the country.

My real concern is every time I talk to SINP they gave me a different answer... I don't know in what believe.

Help :(

You should contact Tracy Davies. She is the manager of SINP. She's quite helpful in regards to these situations.

Tracy Davies
Title Manager
Organization Economic Immigration
Ministry of Economy
Fax (306) 798-0713
Phone (306) 787-0373
Email Tracy.Davies@gov.sk.ca

You will probably lose your nomination if you don't have a employer who will support your SINP. What about you? Are you working? You can reapply for SINP since you are on a open work permit.

How can I reapply for SINP?
I am working as a waitress for now and I just have my open work permit because of my husband (he is the principal applicant Skilled Worker)

Then your best choice is to contact Tracy Davies and see what she says. In the meantime, keep looking for a employer for your husband.

What was his job and what SINP category did he applied under as?
He applied for Skilled Worker in NOC 7284 - Drywall Taper / Painter, with a Job offer.
