I just wanted to show you parts of the email my consultant sent me in regards to my sons medical exam for my PR application. She makes it sound like if my son doesn't do his medical my application will be refused. This is very discouraging after 28 months getting to this point in the process. I have followed everyone advise and sent emails and certified letters to my sons mom and she has not answered them. I have no court papers stating she has sole custody!
This email serves two purposes: to clarify what your next steps are with SON NAME medical exam and to get your updated details to inform IRCC.
1) A. As discussed, if SON NAME completes the medical exam as IRCC has requested, your file should continue on quickly and seamlessly.
B. If he doesn’t, it will be a long, drawn-out fight with IRCC to give you PR. All applicants for permanent residence must have all of their children who are under 19 years old complete the medical exam. If SONS NAME or his mom refuses to allow him to complete the exam, then you must show court documentation that his mom has sole custody of SONS NAME.
C. If you don’t have court documentation and can only show written proof of SONS NAME refusals to take the medical exam, as well as written proof that his mother refuses, after your many attempts to get him to, then the argument about this with IRCC will take many months and may result in your application being refused for non-compliance.
I was wondering if i do get refusal for my PR application is there a appeals process in place I could use. Does any know if I can appeal? Funny thing my consultant is a lawyer and she sure doesn't seem to give me very good direction when I ask question about the immigration process. She almost brushes us off when we have questions.
I very discouraged and confused. Makes me feel like just giving up.
