Hi Everyone,

I just wanted to show you parts of the email my consultant sent me in regards to my sons medical exam for my PR application. She makes it sound like if my son doesn't do his medical my application will be refused. This is very discouraging after 28 months getting to this point in the process. I have followed everyone advise and sent emails and certified letters to my sons mom and she has not answered them. I have no court papers stating she has sole custody!

This email serves two purposes: to clarify what your next steps are with SON NAME medical exam and to get your updated details to inform IRCC.

1) A. As discussed, if SON NAME completes the medical exam as IRCC has requested, your file should continue on quickly and seamlessly.

B. If he doesn’t, it will be a long, drawn-out fight with IRCC to give you PR. All applicants for permanent residence must have all of their children who are under 19 years old complete the medical exam. If SONS NAME or his mom refuses to allow him to complete the exam, then you must show court documentation that his mom has sole custody of SONS NAME.

C. If you don’t have court documentation and can only show written proof of SONS NAME refusals to take the medical exam, as well as written proof that his mother refuses, after your many attempts to get him to, then the argument about this with IRCC will take many months and may result in your application being refused for non-compliance.

I was wondering if i do get refusal for my PR application is there a appeals process in place I could use. Does any know if I can appeal? Funny thing my consultant is a lawyer and she sure doesn't seem to give me very good direction when I ask question about the immigration process. She almost brushes us off when we have questions.

I very discouraged and confused. Makes me feel like just giving up.

i appreciate everyone input on my situation and any more input would really help us understand this complicated system.

Your consultant is an idiot and I suggest you ditch her. Your app will not be refused for this.

I turned in my letter they wanted it done in 30 days about my son's refusal to take his medical. When does immigration ask for it to be turned in? I am confused the people helping me said immigration will ask them for it when they are ready for it to be sent in to them. someone explain this to me, immigration wanted my son's medical done in 30 days or i would be out of compliance. then the i was told by the people helping me they will send it in when immigration ask for it.

i was wondering how long is it suppose to take an inland PR application? I applied 11/08/16. I have a open work permit, can I apply for another one when my current one expires?

if by any chance my PR application does get refused, can I appeal the decision or do i have to leave the country? if i appeal what do i do?

I don't really understand the bolded part of your post. From your previous posts, you were given a deadline of Oct 28th for the child's medical. If you are asking when to send the documentation/letter regarding your son's exclusion, you need to do it by that deadline. This is what you are submitting instead of the medical. IRCC is NOT going to request this documentation from you later on. If you don't send anything by the deadline, your app will likely be refused.

Previously, inland apps took closer to 2 years. With the new timeline, no one really knows yet. If you were issued an OWP based on your PR app, you can extend it if the PR app is going to take longer. Note that you must apply for the extension BEFORE your current permit expires.

I am going to say this only one more time and please accept that the answer is correct and your consultant is an idiot: your app will not be refused for this.

Get it all back from the consultant, scan it and send it by webform today. Then mail it in. If you have trouble getting everything from the consultant, send IRCC a webform stating that you need extra time to respond to the request; as long as you acknowledge their request, it's fine.

Fire your consultant.

Yes, mail the hard copy as well. It needs to go to the Mississauga office. You shouldn't need the consultant's info.

While your wife may need to do the firing, you can still remove this person as your representative.

Thanks for your help. It is done, I emailed cic twice but I think that was ok because the first email didn’t pick up the attachment. So I sent a second email with better explanation and my letter of explanation we able to attachment and explained that the hard copy would have all 22 pages back with it.
Then I mailed the hard copy to on Mississauga. Told them they should get it two or three week. I even found a state law that give her sole custody so I attached that with my explanation.

In summary, I send hard copy of about 26 pages (includes emails, state law info, copy of certified letters, paid letter receipts, family lawyer email, and letter schedule of delivery), attach six page letter of explanation, and two emails to them. She never answered not one of the communications I sent.

I sure hope that is enough information demonstrated I tried to my medical done. I greatful for everyone help.

Then to top things off the consultant never even answered my email asking how to use the webform. She did say my application was not submitted online

I want to thank everyone again. Now I get a letter from immigration stating they want more proof that my wife and I are living together. They want bills in both of our names. Everything is in her name when I moved in with her. I do have letter from my bank, some doctors bills, and a letter from my employer all showing my address.

Does anyone have any other idea what things i can use to show proof i am living with her. I’m don’t what more I can give them.

What proofs did you originally submit?

Lease/letter from landlord, any mail in both and/or individual names, joint bank/credit card statements, cell phone bills, shipping receipts, payslips, tax documents, IDs, bank transfers showing you share the household expenses, letters from neighbors etc.

But since I did start a job, have s new bank account, did get my work permit mailed to me at our place, I do have a eyes doctor and dentist bills with our address, my sin number should have our address on it, not sure if my fbi report has the address.....

Is there anything else I can do? I do have a bank account in the USA that sends my mail to my Canadian address.
