@legalfalcon Need your counsel.
Taking your advice, I raised a CSE and got the AOR soon after. I also submitted my passport for renewal under normal category which is currently in process.

Now last night, much earlier than anticipated, I received the email for PPR, which throws me in a bit of a quandary with regards to my passport. Two questions:

My whole application is based on my old passport, which has now "CANCELLED" stamped across it. I have applied for the passport renewal, which is in progress (non-tatkal). It may take a while. I have not yet intimated the CIC about my passport renewal (thought of doing it when I had my renewed passport). I also have the acknowledgement slip from the PSK (Passport office) of my renewal application.
Question - I have 30 days from 19-Sept-2017 to submit my passport. In your opinion, what would be the best course of action for me in this situation?

I got the email, but status of my CIC account remains unchanged, as follows:
Application status - We are processing your application. We will send you a message when there is an update or if we need more information from you.
Review of eligibility - We are reviewing whether you meet the eligibility requirements.
Review of medical results - You passed the medical exam.
Review of additional documents - The additional documents you provided are being reviewed.
Interview - You do not need an interview. We will send you a message if this changes.
Biometrics - We do not need your fingerprints. We will send you a message if this changes.
Background check - We are processing your background check. We will send you a message if we need more information.
Final decision - Your application is in progress. We will send you a message once the final decision has been made.
Question - Should this be a cause of concern?

Thank you!

hey, I have a concern. I am Iranian and I am in SS now. I have a strong feeling that they paused processing Iranian applications since Dec 2016. I have many friends who have been waiting more than 8 months. If you look at the tracker it is clear that only one in-land applicant got PPR since last year. I think it is likely that it is our natopnality rather than anything case specific. I thing it is a real discrimination to hold on to some applications just because of their nationality and At least I believe they can inform us on the expected time to get our PPR. Now my question is this: what is the best way of raising a general concern regarding this matter?

As per IRCC:

The applicant must have accumulated at least one year of continuous full-time (or the equivalent in part-time) paid work experience in the occupation identified in their application for permanent residence as their primary occupation. In calculating this period of work experience, the occupation must be listed in skill type 0 (Managerial occupations), skill level A (Professional occupations) or skill level B (Technical occupations and skilled trades) of the National Occupational Classification (NOC) 2011 [R75(2)(a)].

The applicant’s skilled work experience must also

  • have occurred within the ten years preceding the date of their application for permanent residence; and
  • not be in an occupation that has been designated as a restricted occupation.
Note: At the time of publication, no occupations were designated as restricted.

In addition, during that period of employment, the applicant must have

  • performed the actions described in the lead statement for the occupation as set out in the occupational description of the NOC [R75(2)(b)]; and
  • performed a substantial number of the main duties, including all of the essential duties, of the occupation as set out in the occupational description of the NOC [R75(2)(c)].
Note: The applicant does not need to demonstrate that they meet the “employment requirements” listed in the NOC occupational description.

When you select a NOC, you only have to see the job duties that match with your duties the most, not the qualifications.
Thank you @legalfalcon for your help! Kudos!

When you land, you can use the same letters which you used as PoF. All the CBSA officer will need to see is that you have the funds, not that you are bringing them with you. As regards the conversion, when you land the 6 month average balance is not required and neither is the IRCC format letter.

So you can carry some money with you in cash or monetary instrument, and show the rest in your account back in your home country.

If you have any further questions ask.

Thanks @legalfalcon for allaying my fears. Your answer to my question is consistent with @IRCC twitter handle. They said proof of fund is frozen at AOR so it can no longer be affected by any forex fluctuations even at landing.

I´m sorry, a follow up question. I`m in the process of obtaining the requested PCC. Will my application be on hold, or would it go through eligibility meanwhile?
That is at the discretion of the officer. Usually they put the application on hold until the document is filed.

I mean, if I enter my wife's ECA details post changing the spouse accompany status, then would it be a problem, since I got her ECA done recently.
That is no issue. Only the PA has to have the ECA and Language score before creating the file. For a family member as and when the information becomes available it can be added in the profile.

Hi LegalFalcon,

I am stuck on security screening since Jan 24. 1 months ago received CSIS gcms notes which says they have completed my screening on June 24 and there the client was CBSA. 2months ago I requested CBSA gcms notes and today I received CBSA gcms notes. They have sent a CD which contains the last gcms notes from CIC with all my uploaded documents! I don't get it why CBSA is sending me old CIC gcms notes! Have you seen this before that CBSA sending old CIC gcms notes.

Thanks a lot @legalfalcon

Also the reason for her to be excluded in the beginning was her father met with an accident in Mar and expected to have some one to help his mother till some time. However now her father and mother have forced her to accompany me to by pass family sponsorship since it will take more time to get. So what proofs and explanation can I mention about this in LOE. Thanks for your help

@legalfalcon : Any inside view about PNP - Out-lander application delay? I have seen many applicants starting from April to July are stacked at NA2 with in short period of time and now there is no movement since last one month.

He is returning his home come country after E-APR. If he returns before ppr, will he have to provide ppc again. I mean pcc that shows record till he leaves the contry he is in right now.
I am in the similar case.so asking.i have sent you a message as well.please help to revert there

As per IRCC:

  • For the applicant’s current country of residence, the police certificate must have been issued no more than six months before the submission of the e-APR.
  • For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant lived in that country.

So if you are changing your country of residence the PCC should be issued after you lived there, so that is after you exit the country. If it is issued before you leave, you will be asked to obtain a new one.

If you believe that you will not be able to get the renewed passport before the 30 day window, then you should immediately inform IRCC and seek an extension.

As regards the status on your MyCIC account, it will continue to be like this until a visa is issued to you and you get the CoPR, that is when your status will change to approved.

I believe we discussed this on WhatsAPP too. But I believe that you should get in touch with Iranian Community in Canada and raise this issue. Also send a letter signed by as many Iranians applicants to the Minister of Immigration. That will put pressure and get you some results.

Re: Letter of Explanation regarding 'Yes' response to Statutory Question "Has [your name] ever been arrested or charged with a crime?"

Dear Sir/Madame (or To Whom It May Concern):

Thank you for considering my application, thus far. If you will permit me, I would like to provide clarification on why I have responded "Yes" to Statutory Question "Has [your name] ever been arrested or charged with a crime?" in my electronic application for permanent residency.

Criminal charges of- 264(01) 264(03)A) and 264.1(1)A)(2)A) - were brought against me by a gentleman with whom I was previously in a relationship. However, on January 6, 2016, a decision was made, and the charges were withdrawn

I wish to affirm that I engaged in no wrongdoing and the accusations were false; however, as I was arrested and charged prior to the charges being dropped, I wanted to be as upfront as possible with regard to the situation.

In support of my affirmation, and my application, I have attached my certified RCMP criminal record check, as well as documents of the disposition outlining the Court judgment with regard to the criminal charges, for your review.

If you have any questions or concerns, please let me know and, thank you, again, for your review and consideration of my application.

Yours sincerely,

This usually happens when you do not make it clear to the nature of the request. The request, which for CBSA is a sentence or two should be narrow enough. If you simply ask for your application details, they will send IRCC. However if you narrow it down, they will send what they have on record.
