INTERESTING STORY....visa denied, about to submit appeal, visa officer changed mind!!

It has been hair raising experience with BJ VO. There were four sponsorship applicants waiting to be interview. No one pass the interview that day. All four applicants were DECLINED including my wife.

My wife was scheduled for her interview on June 06, 2013 at 9 am but waited till 13:30 pm before she was called in to the room. She was interviewed for 1:45 minutes till 15:45 pm. She came out crying that the Visa Officer told her that she did not pass.

I returned to Vancouver, BC and was ready to make an Appeal case. There is a time limit of 30 days upon receiving the Refusal letter. On June 21, 2013, I submitted the Appeal Application to Immigration Appeal Division (IAD).

Then tonight at midnight Vancouver time about 15:00 BJ time. I received a call from BJ VO from the VO whom interviewed my wife, says that she has reviewed the whole file and has APPROVED her case. The VO asked for her passport back for VISA ISSUING. I was totally stunned; nevertheless, we are very happy and excited.

Hopefully, no one should go through this drama like we did. Thanks everyone for all your supports and comments. I will still be on the forum.

Good luck ALL!

VISA DENIED AND APPEAL SUBMITTED.

POSTED BY Taycaoco on: August 23, 2013, 06:33:16 am

The interview of my wife took place this morning. I think it went wrong. They said that my wedding was held too soon after I met my wife (4 months after our first phone conversation).

They also asked why my mother did not come to our wedding. The reason is simple, she's the manager of a store and no one could replace her during the busy holiday season. But my father and my grandparents, uncles, aunts, cousins, etc. were present.

They also said that I have not visited my wife often enough. *censored word*! Would they pay all my bills and the plane ticket and I would stay in Vietnam six months per year!

After the interview, they just said that my wife will receive a letter in 6 weeks. That's it.

That does not bode well... I've been married for almost 3 years now. How many years do I have to wait again? If our request is denied, I will go to appeal. We are wasting our best years of our lives. It's so unfair!

Hi all,

I have filed an appeal with the IAD Registry Office of Montreal in January 2014. If the idots from CIC believe that they could destroy my marriage by refusing to issue the permanent residence visa to my wife, they're only deluding themselves.

They believe wrongly that a long wait of 2 or 3 years to appear before the judge will discourage my wife and I and make us break. Ha! Ha! Ha! They're so wrong! They should be aware that all the trials and obstacles that they impose on us unfairly will only strengthen the love that we feel for each other. The only person who would be the most unfortunate will be our future child to be born in Vietnam. He will live the early years of his life away from his father, but the day will come when all our family will be reunited here in Canada. No! We will never let the shabby decision of an incompetent official ruin our happiness!

Last Friday, I received a package from the IAD containing some pieces of evidences. Curiously, they did not include the strongest evidences in my favor! It's obvious they do withhold information. Therefore, I myself will send the evidence to IAD...........

I kinda feel sorry for Taycaoco, because just like me, he has a wife from Vietnam, but people from those countries have been waiting a long time. The Vietnam thread is just full of people with refusals and interviews.

VISA DENIED-AGE GAP. APPEAL TO OVERTURN THE DECISION.

POSTED BY Abe1004:

Quote from: negmeg on June 04, 2014, 10:53:39 am

Has there been any update on your file? Did embassy contact you about their decision?

Hope you will hear the good news very soon,

Abe2004:

Negmeg, we actually did hear back and we heard back bad news. Apparently we married too fast before my departure (three days prior) and that we have age difference( i am younger) is a role in her negative decision.

She totally ignored that we dated (lived together, shared bank account, leases, credit etc) 2.4 years prior to that.

She also totally ignored all other proof: cards, notarized testemonials, photos and 6000 pages of logs from feb 2013 till today.

During the interview I answered all questions, but she ignored that, even though she had no arguements (at all).

Oh well. Just more grief, frustration and time to waste before I am reunited with my loved one, but it will happen.

We been together for 4 years now, it puts in prespective, how miserable person can ruin someones life, but it will only make us stronger.

We going to emerge victorious. If by any means she is reading this, I hope I could tell her that karma is a bit ch it will catch up to her sooner than later.

SUBSEQUENT POST:

Me and my wife got refused on 28th of april, on grounds that she is older than me and we married 3 days prior to my leave from Canada (we lived together for 2.6 years with all supporting proof (lease agreements, credits, bank accounts etc) prior to our marriage).

We just had a really opinionated officer. She is devastated but I am not losing hope.

We filed the appeal yesterday June 2nd.We lived in Manitoba, so ur appeal goes to Van-city.

Does it usually mean faster appeal process than Toronto area?

Regards

PHONE INTERVIEW WITH THE SPONSOR

POSTED BY Mushmash (US outland):

Quote from: Saied on January 08, 2014, 11:07:49 am
Hello guys,
I sponsored my wife from Bangladesh about a year ago. I received a call from Singapore immigration and had a phone interview with them. after the phone talk they told me that they will notify my wife in email after reviewing the file. Did anyone faced this before? how long will it take them to let us know their decision? it's already been 3 days since I did the phone interview. Please co-operate with your experience in this matter or give me the answer if you know. Being tensed feel really horrible at this stage after waiting for long one year.

Mushmash (Got visa in March,2014):

Hello, I'm on a similar boat. I had an interview with the Ottawa office and it's been 3 weeks so if that helps, I haven't heard anything yet............

Based on what the officer said gave us the impression that it went well. It lasted about an hour, both my wife and I went at the same time. Lots of personal questions about the development of our relationship, engagement, wedding etc. The officer was very professional and polite which made the whole process a lot easier.

Yes true. Also they have allergies to big age gap, different education level, religion, previous marriage or relationship etc etc. I hope you already asked for GCMS notes.

hey there,

So my husband and I were recently denied too... so I am hoping so of you could shed some light on this whole appeal process
here are our details
applied april 2012
received july 2012

It seemed that we were denied on the basis of me being older than my husband... i am 36 and he is 28. He is and Egyptian Muslim and I am a Canadian Convert.
We have been together 4 years and married for almost 2.
I have met with a consultant and be advised that I must wait for the rejection letter which we have not yet received and then order CAIPS notes and go from there...
does anyone know how long the appeal process takes?Huh I hear it depends where you live... I live in Winnipeg Manitoba...

Can you enlighten the forum members please? You said previously that your husband's application was rejected after the interview and now you mention issuance of visa.

Sure, our story is a bit complicated. Initially we were rejected last May, due to our relationship not being "genuine". I immediately hired a consultant to help us, but we were stuck as the embassy didnt send us a formal rejection letter. So I ordered my Caips notes and from what was written on the caips notes, my consultant drafted a long letter countering every negative point the VO listed. He then sent it with much proof to the Embassy for an "Administrative Review" in essence like an "Informal Appeal". After the Administrator in the Embassy reviewed the letter and our case, they agreed to re open it and invited my husband for a second interview (Oct. 8th). I flew down to be with him for the interview, but after chatting with my husband for just under 1 hr the VO said that he was convinced and that he would give my husband the visa, all we had to do is renew his criminal and medical checks. Soooooo now just over a month later, my husband is with Visa in his hand Smiley El humdulillah!!!
My Consultant is amazing at what he does, and for anyone interested, I would be more than happy to share his information with you.

INTERVIEW EXPERIENCE

Quote from: Egyptian man on May 27, 2013, 05:56:54 am
this is my experience in the Cairo visa office.
i had my interview at the morning of (Sunday, May 12, 2013) at 9:00 am. In interview room 5 with an elderly man wearing glasses. The man didn't introduce himself, so i cannot tell you his name.
I'm applying under the family class sponsorship. me and my wife have know each other since Oct 2009, we have been married since the beginning of 2012.
The man was very abrupt! He would not listen to what i was answering. He would only keep saying, "I am not satisfied!!"
I'm a liberal Muslim and my wife is Christian..."Very unusual" he said. I ask this... people of this world are not allowed to marry people of other religions???
The man also asked about our age difference. When I told him that love is blind and we don't feel that difference at all , The man sniggered.
The man asked me if he wanted to go to Canada, when I said, "I want to go to my wife" The man said, "That is not what i asked you!" he replied it ..i replied the same answer , he said with angrily voice to answer with yes or no so i said yes.... to my wife .
I had brought photos and papers to prove our ongoing relationship, the man would not look at them.
i met a freeislam , who had an interview on the same day said that he had an interview with the same man, and he had the same treatment from the interviewer. the same rudeness.
has told me that he has found out that there were 9 interviews on May 12, and so far he has talked to 6 of them, and they all have said that they talked to the same older gentleman in interview room 5. And he was so racist with all of them .
After waiting for sooo long and to finally hear that we had an interview, i am very disappointed about our treatment. All we want is to be together, we are in love. It is not fair treatment. We have been together for 43 months, we talk everyday for hours!!! We probably talk more than people who are together in the same room. Now we want to live together and have a normal life
I want to add something: I have found out that of the nine interviews that happened that day, the one that involved a Canadian wife being present. Only that couple was given a verbal approval and the rest of them kept telling them I'm not satisfied l. it takes a Canadian to be present in the interview to prove that a marriage is genuine.
I am very upset and angry about all of this. The man asking the interview questions was only asking about Egyptian customs. me and my wife are married. An Egyptian and a Canadian. This marriage is not only about his customs, it is about OUR customs!! We are 2 people in this marriage, not one !!!! We have discussed our differences, we are positive that we want to spend the rest of our lives together.
Only my husband is Egyptian, and not all of our relationship was done according to his "customs". Two different people involved with different backgrounds and cultures means that not everything will be from one perspective. Customs or expectations come from each side of our relationship. It is important that together we create what we can both agree on. NOT just the Egyptian culture and or customs.
we sent everything in the application ( photos , MSN conversations history, tickets , gifts , ) to prove that our marriage is genuine
decision has been made but no letter yet , two weeks now after that horrible interview .
i emailed the embassy and the minister but no respond at all .
