I am currently on H1 in the US and I am a Canadian PR. I have been at my current job for about 4 years and I am planning to relocate to Toronto in June and continue working remotely from there. I am in the process of bringing this to my boss but I would like to have as much info as possible before I do so. I have done some intense research and consulted with our immigration lawyer (concerning my H1) and my company's payroll. Payroll confirmed that we aren't set-up for Canada (HRIS/payroll) so I won't even be able to change my address in the system to a non-US address. My sister will be moving in so I will be receiving most of my mail here anyway but I will not be paying rent etc. I'm also not sure of how often I'll be in the US, maybe once every 2 or 3 months, but it isn't set in stone.
However, here are my questions -
1. If my employer somehow manages to keep me on the payroll as an employee and they have all the taxes deducted from my paycheck, will there be any issues for my Employer in the future? I am concerned about this because they've been really good to me and I'd hate to screw them over after they do me this favor. Will I be the only one assuming all the risks that come with filing both taxes etc. or will they be fined for having a non-resident on the payroll as an employee?
2. I've read all about the pros of going with a PEO/GEO, but what are the cons (apart from the fees)? Is there anything I need to be aware of while going into this agreement? Also are there any PEOs that are highly recommended?
