Hello all

here's the situation i need some help/insight/or knowledge from previous experience from:

I became a PR 4 years ago and meet all the residency obligations etc to maintain my PR.
I am at the moment waiting for my AOR1 and SA for my spouse who is in India - outland app.

He is leaving to go work in China for a few months.
I had planned to visit and stay with him for the time he will be there. I had called up CIC to confirm if that would be okay- lady said as long as I am visiting its okay.

Now, I have been offered a temporary position by his company to work there for the duration of my stay.I will be signing a 4 month contract.
This will require me to obtain a work visa-and which after 30 days gets re-issued as a temporary residence permit(which is 6 months long), as opposed to the visit visa.

Just wondering if this work situation will spoil my sponsorship app. or my spouses' application?
Should I just send in a letter to CIC stating my intentions, that we want to be together after our wedding,and I want to work to earn extra money, and I will be back once his work is done.

Any advice would be great...!

I wouldn't do it. It looks too much like you're not visiting.

The short answer is no - you can't do this.

Since you are a PR, you must be living in Canada when you submit the application to sponsor your spouse and must continue living in Canada until the application is finalized. Short trips (e.g. three week) outside of Canada are OK. Anything longer and you should expect there's a high chance the sponsorship application will be refused.

It's doubtful the CIC is going to look at a 4 month absence and consider it a vacation.

The problem is I don't think there's a clear rule about what constitutes a vacation in this circumstance. You're kind of playing with fire by leaving the country in the first place, but going for an extended time and working while there adds more fuel to the fire.

Of course it can. But there's no guarantees and doing it puts the application at risk.

No - you can't. At least not without putting the PR application in jeopardy.

Again - it doesn't matter why you are away from Canada (vacation, work, studies). As a PR, you must be living in Canada to qualify to sponsor a spouse. So regardless of the reason, any prolonged absence will put your sponsorship application in jeopardy of being refused. Only Canadian citizens can sponsor from outside of Canada. This is one of the benefits of citizenship.

This is so horrible!

Here I was, thinking I got lucky getting a chance to be with my husband for a good chunk of the waiting period!
I am not comfortable with jeopardizing our otherwise straight forward application.

I guess,this means I'll limit my visit to 3-4 weeks :( :(

Up to 4 weeks is safe. Anything more is a risk. No can say if you will be fine or not. Basically it all comes down to your risk tolerance.
