I recently moved back to Canada with my family from the states. I am Canadian and my husband is American. We are working on a spousal sponsorship but he has been given a really good job offer. Is there anyway that he can get a work permit while we finish the paperwork and once it's done will he have to leave or lose his job? There is so much info out there it gets really confusing, so I would really appreciate any help. Thank you ???
 
To those that hav experience with this. I am the american she is referring to. the job offer is a fulltime perm job. I am here on visitor status. I am an American. I have till this Monday to accept or refuse this job offer.
 
Unless you fall under NAFTA, your employer will have to apply for a Labour Market Opinion first (and be approved) in order to hire you. More information on LMOs is here:

If the employer applies for an LMO and it's approved, you would then apply for a work permit. Once the work permit is approved, you can start working.
 
Just to add...

If you are eventually approved for a work permit, applying for PR will have no impact on your ability to work.
 
Can i place a OWP with my sponsorship application to avoid the LMO?

Since i am doing an inland Sponsorship?

Unfortunately you won't qualify for an OWP until stage 1 of inland processing has been completed. That's currently taking 12-13 months.

FYI - as an American you really should be applying outland (even if you're here in Canada). WAY faster.
 
Oh - and just to be clear...

Yes - you can certainly include an OWP application with your inland application.

No - this won't allow you to avoid the LMO if you want to work now. The OWP will only become useful once stage 1 processing is complete in 12-13 months. Until then, you'll need an LMO to work.

Again, apply outland.

There is no stage one in outland applications. Presently it is 54 days at Mississauga for Sponsor approval/refusal and 11 months for 80% of spousal applications at Buffalo.
 
Exactly as PMM said. There is no stage 1 and OWP for outland. You qualify to work once your file has been approved and you have landed in Canada as a PR.

The 11 months for outland is not a fixed processing time. This is how long it took them to process 80% of applications. This means that many get through significantly faster. My husband's application (for example) was finalized in 4 months total. These days many people seem to be getting through at the six month mark.

Unlike outland, the 12-13 months for stage 1 inland is a fixed processing time. In other words, you should expect to wait the full 12-13 months to receive stage 1 approval.

I intend on asking this afternoon. I am concerned if i would pass the LMO process.
I have been offered a supervisor role with Real Canadian Superstore.

I have over 10 years managerial experience in Grocery Stores. They really like me and are fitting me into this role.

If they searched hard enough i would say with full honestly a Canadian could fill this role. I dont think id get approved...but maybe im wrong.
