Work Permit expired but lawyer filed me under VISITOR VISA

Work permit expired while my application was in process does this mean I am in "implied status"? My medical has been done and landing fees PRFP has been paid in January 16th 2014. But I have yet to hear from them on the decision. What might be the reason they are taking forever to make a decision?
