I had sent my full application to Buffalo after getting Initial approval from Nova Scotia CIO on Dec 31, 2009. On Feb 4, 2010 my application packet was sent back by Buffalo office saying that some of the portion is missing on my wife's background history form and had asked me to resubmit the application within 60 days. Due to some reasons I'm no longer interested in applying again and wanted to know if I can withdraw my application and if yes, will I get the application fee back.

On the letter accompanying the application packet, it is written that my application documents are being sent back in entirety and no record is kept. Does it mean that the processing for my application has still not started and i can successfully withdraw the application.

On ecas, my status shows as initial review compelted at CIO, Sydney...does it mean that i can successfully withdraw my application>
 
Yes you can withdraw your application.
Please follow the withdrawal process and you will get ur refund in 2-3 moths time.
 
Thanks so much for the reply but i have one doubt.

The fact that they saw reviewed my application and asked me to submit more documents- doesnt it mean that my application is in processing now and i cant get refund....pls advice.
 
Application processing is done from ur local CHC and not by CIO.
So you can withdraw ur application from CIO anytime u want.

Irshad, the mail asking for more documents was from CHC Buffalo only as i sent my full application to them on Dec, 2009...got this mail in feb 2010....thats why i think that since the Buffalo office has already reviewd the application and sent back to me asking for some more documents it means processing has started. pls advise
 
What is ur e-case status ?
 
Thats cool then as they have not started processing your application.
Mail them about the withdrawal and withdraw ur application.
 
If you want to withdraw the application, please send a letter to CHC Buffalo as file is transferred there from CIO Sydney

the thing which bothers me is the phrase: Äll of your application forms and documents are being returned to you in this package. No record of your application has been retained by this office. Please return this letter and the attached appendices when you resubmit your application

So do i need to resubmit the application and then send withdrawal letter or shall i just attach this letter from CHC buffalo with my withdrawal application and not submit the application at all.

Please advice, thanks a lot.

You are entitled for refund. You can send them a letter saying that you are no more interested in pursuing it and would like to withdraw you application.
 
Send a letter (or fax) to Buffalo requesting withdrawal of the application and a refund of the application fee. Send a copy of the letter you received from CIO (it will have a file number and the receipt number for your application fee).
