I am moving to Toronto to start a job there this fall. My wife was convicted of a DWI 7 years ago, and I was wondering whether this will present a problem for her coming with me. I'm not sure if it makes a difference, but she was under the legal alcohol limit--she was just involved in a minor traffic accident and deemed intoxicated. Who makes the decision on whether she can come through? Is it the agent at the border when we come in?

she is deemed inadmissible to canada as of now DUI is a serious criminal act in canada and she needs to be 10 or 5 years if i am correct(seniors can correct me) since this happens and apply for a pardon before she can enter canada.

If 5 years have passed since the completion of the sentence, then she can apply for rehabilitation. At the present time she is inadmissible to Canada. See: http://www.cic.gc.ca/english/information/applications/rehabil.asp
