Will it be a misrepresentation if I does not include my Canadian relative?

Hi Seniors,

I have some difficulties to provide the proof of relationship with my close relative who is a Canadian and lives there.
Will it be OK to put "NO" under the following questions:

Does [My Name] have a relative who is a citizen or permanent resident of Canada? (The relative must be 18 or older and living in Canada.)

I have sufficient points with out the 5 points from relatives and just need to confirm whether it will constitute a misrepresentation if I answer "NO".

My personal opinion, it would amount to misrepresentation only when you claim points for something which you are not eligible or hiding facts which could have an adverse impact on your application. In your case you are not claiming points as you already have enough points, it should be fine.

To be on the safer side, you can just have an LOE explaining why you have not claimed points for Canadian relative would make your case clear to the Case Officer and therefore no misrepresentation. But I still feel you can mention this relative in your Statement of Intent to settle in Canada.

It is a misrepresentation only if you intentionally make false claims using fake documents or false witnesses. If you don't provide proof for a claim, at worse it would be reconsider as if you didn't declare the claim and may or may not reject your application.

But wherever possible providing a LOE explaining your situation wouldn't hurt.

It's normal to do this when you can't prove the relationship for any reason. No worries.
