Husband is currently working in Canada on a working visa, he applied for a family class visa wherein he is the principal sponsor for wife and 2 kids. Passports are already sent for visa issuance.

What will happen to principal sponsor if wife changes her mind and decided not to join husband in Canada anymore. She refused to land with the kids before visa expiry. Will it affect the PR visa of the principal sponsor?

Please advice.

It will not affect the PR status of the principal applicant. The wife and children will lose their PR visa if they let it expire but as they already had a PR visa before and have gone through medicals etc. it would be possible for the husband to sponsor them later if they change their minds. The children however only as long as they are considered dependent which is as long as they are not married and either under 22 or full time students since before the age of 22.

In this case what procedures does the husband need to do after he receives his passport with visa assuming that his family wont join him anymore.

Thank you so much...you're a big help!

Your Best bet would be try to convince your wife to come to Canada along with the children for their future. Even if she decides against living with you she can decide to come for better future of her kids. Also try if you guys can sort out the differences because once your dependents are cancelled for the PR status you cannot sponsor them again.

Last but not the least if none of the above situations work out i would suggest to enter Canada and then after living here for like 6 months you can notify the High Commission in the Home Country that your dependents are no longer willing to come to Canada as they have changed their minds now. I would take this as my last resort.

Leon is telling... that the wife and children will lose their PR visa if they let it expire but as they already had a PR visa before and have gone through medicals etc. it would be possible for the husband to sponsor them later if they change their minds.

Namb is telling... once dependents are cancelled for the PR status principal cannot sponsor them again.

Which one is correct?

Better future in not only in Canada..its everywhere and anywhere.

LEON is correct if your dependents remain your dependents..mean to say if later the couple are not legally together then sponsorer would not be able to sponsor the spouse. However if you win the legal custody of your kids you can sponsor them later also.

You do not have to take any steps after you land. The wife and children have their PR visas and they are free to use them until they expire. If they let them expire, obviously they can not use them any more.

If your wife changes her mind, you can sponsor her and the kids again as long as you are not divorced. If your wife does not want to come, namb is right in that if the children are still minor, you would need to have custody of the children to sponsor them to Canada against her will but once they reach the age of majority, whatever that is in your country and they are still unmarried and under 22, they can be sponsored by you if you and they want that.

Many thanks to both of you.
I am the wife who decided not to join my husband in Canada. The kids are with me studying in a good school. My husband applied for a family visa which is now in its final stage. We are already requested for our passports for visa stamping.

I did not want to join him in Canada from the very start as I have already established my career in the Middle East. But as I want him to get his permanent visa, I obliged to coordinate with him in the processing. My plan which until now he is now aware of is let this visa finalized and then tell him of my unwillness to join him. I dont have plans to land. What will be his next move so as not to affect his PR visa. Is it a must that he has to report this matter to immigration? What are the procedures?

As LEON suggested do nothing just let the PR VISA come, let him go and settle down. You don't need to report the matter to anybody till the time you are legally married. In case in future he needs to sponsor you if your PR expires it would be must that you guys are legally together.

I wish you guys happy and prosperous life ahead and success to kids

Hi bonus

I would encourage you to land with the kids just to secure the PR you never know how things may turn. Land now, I think you can live outside of Canada for 2 yrs...I dont think you have much to lose doing it this way..

Who knows you may go and love it there!!!

Keep ur options open....my 2 cents!

I also urge you to land, or at least let your children land with your husband and then return to your country. You never know what will happen in the future. I hate to say it, but what if you died? Your children could easily to live with their father and have a good life in Canada.

The husband does not have to report anything. He can get his visa and land, you get your visa and don't land. If you want to have your PR as a backup, leave it until your PR visa is almost expired to buy time and then land with the kids and then go back to your home country. You can stay outside Canada for up to 3 years without losing your PR. The kids can visit the dad in Canada during school holidays. When he is ready to apply for his Canadian citizenship after 3 years of living in Canada, he can apply for the kids too. As long as they haven't lost their PR's due to residency requirements yet, minor children do not have to have lived in Canada for 3 years to get citizenship as long as the parent is applying. It would make it very easy for your kids if they have dual citizenship, can come and go as they please, work in Canada if they want to, study without needing a student visa and without paying international student fees etc. Think about it. Still, if it doesn't work out with landing, he can always sponsor them later.
