Hi All,

Me and my spouse just living separately, its been 6 months but we have no plans on making it legal. In my application should I select 'Legally Separated' or 'Divorced/Separated'? I feel that Legally Separation is more accurate.

Would i need any specific documents to prove this? I would like to avoid any documents which requires my spouses signature.

You would need your spouse signature for any document that would validate your statement. Or just select unmarried If you don't have your spouse name mentioned anywhere in your documents & YOU DON'T INTEND to bring him/her to Canada EVER.

Selecting unmarried would be an outright misrepresentation even if the spouse's name is not included on any documentation other than the marriage certificate. For the purposes of immigration, you have to provide legal documentation supporting your separated status. If your estranged spouse is amenable to the idea, have them share the necessary documents for your to apply by yourself (non-accompanying spouse).
