Hi all,

I have seen that this blog site gives alot of useful tips on the Canadian Immigration process. I hope someone can maybe support me in providing some tips on how to approach my application for immigration.

My situation:
I (Dutch) am married to a Canadian. We have 2 daughters who are both born in the Netherlands. In 2013 we moved to Canada, after being transferred with my company. At that time I was legally allowed to live here thanks to my work permit.

Unfortunately, due to lack of projects, and potential lay-off, I resigned early 2015 and got a new job in Germany, and moved there. My family however stayed behind in Canada.

We are now looking to start the immigration under Family Class, but there are two questions I hope someone can maybe help me out with:

1. As our children are born to a Canadian parent (of the first generation), they are officially Canadian. Do they still need to be included in the sponsorship application?
2. Can my Canadian working history be beneficial in the speed of my application?

No, they are not considered dependents for CIC purposes. Just include them in the "other family info" form, and include proof of their citizenship (passports, citizenship certificates, etc). They do NOT need to do medicals.

No, it's irrelevant to your family class application.
 
I can only answer 2 but a working history likely will not change your processing speed at all.

Option 1:
Submit an Outland Spousal Sponsorship application package now. You could possibly even return to Canada, as a visitor, while the application is being processed.

Option 2:
Return to Canada and the submit an Inland application, along with an Open Work Permit. This will be a long process (~ 27 months total), but having the ability to work ~ 4 months after submitting the application, is appealing for some applicants. It's a matter of what is more important to you and your family.

Thanks Ponga. We have looked at both options indeed. For now we choose for the first option. Not nice to be away from family, but it is a safer option. Also, as in the second option, you are not allowed to leave the country.
