Hi Everyone,

I have a quick questions - I am here in Canada on a visitors visa and have gotten married to my husband who is a Canadian citizen. We want to apply outland to Warsaw while I remain here in Canada as a visitor. I understand I am allowed to do this correct? If so, which application form do I use - IMM 3900 or IMM 5289

The language is confusing in IMM 5289:

This application is for spouses or common-law partners of Canadian citizens or permanent residents who wish to apply for permanent residence while both the sponsor and the applicant are residing in Canada.

If the applicant does not reside in Canada, DO NOT use this form.


I am residing in Canada but on a visitors visa so do I use this form for applying outland or do I have to use IMM 3900. I have already gotten my police records check from my home country and done my medicals here in Canada.

How to apply

There are three steps to apply to sponsor your spouse, partner or children:

The application for permanent residence packages are different depending on whether your relatives live inside or outside Canada. Be sure to choose the correct application package.

If your spouse, partner or accompanying dependent child lives with you in Canada, use the Application for Permanent Residence in Canada—Spouse or Common-law Partner.
If your spouse, partner or dependent child lives outside Canada, use the Application to Sponsor a Member of the Family Class (FC).
If you are approved as a sponsor, the CPC will forward your family member’s application for permanent residence to the appropriate Canadian visa office to continue its processing.

Even though you are in Canada now, it's common to apply from your overseas visa office to save time. You will apply and use all forms as if outland/out of Canada.
