We are currently gathering and completing documents for common-law sponsorship. My common law partner (Canadian citizen) is still married but declared that they're already separated since 2011. His CRA tax form indicates separated in marital status. According to the checklist, we need to include divorce/annulment/separation document. How can we get this document? Pls, help

Is your partner had a children with his previous wife and assets to be divided? If none, then it will be easy for him to make a separation affidavit.

He has to go to any lawyer or notary public for statutory declaration and it must stated there when was the separation happened, the chance of getting back together is impossible and also states in the affidavit that he is currently in Common-Law Relationship with you.

Include the CRA document about him being separated since it is important proof that he is indeed separated and chime/support his affidavit of separation.

P.S Lawyer can make an Affidavit or what we called Statutory of Declaration here in Canada. I'm sure there ate many lawyers who can help you there in Phil's.

Thanks, Carlaganda! :) we'll just find a lawyer here in the philippines then for the affidavit.....is the statutory declaration of common law union form can also be notarized by a lawyer here in the philippines (one of the forms in the app package) ? :)

I went to Commissioner of Oath with mine, but it wouldn't matter at all. Just made a copy for yourself in case they will ask again later on.
 
Can i butt in coz i have the same problem manila embassy ask me a DIVORCE DOCUMENT/INFORMATION OF MY SPONSOR.. He is unmarried before but he has 3 kids to hes previous relationships. I just submitted a paper that proving that hes not married before is this document is ok or not?? TIA

You have to make declaration of Severance of Common Law Union, if your partner had a Common Law Partner before then he has to do it.

If no Common Law or Ex-wife just made a Statutory Declaration stating that he never had a wife or Common -Law and he has to explain how come he has 3 kids if he hasn't got previous Common Law/ wife. What was the living arrangement. I'm sure there are plenty of lawyers can help you to do it.

It only costs 50$ to make it from the lawyer and they have knowledge what to put in the affidavit. You just have to explain and let him know the situation.

Awww thanks for ur reply im worried now coz i think i submitted a wrong paper.. Where to get this only at my hubby's place CA? TIA

He can asks any lawyer here in Canada about the Statutory Declaration attesting about his personal circumstances and his previous relationships.

If he has Common-Law before or not and all that kind of stuffs. You have to get the CRA documents too to confirmed that he was never married before .

Thank u so much for your time and reply carlaganda.. What CRA it isa civil bla bla? I think that is the document we submitted showing that he never married before..

CRA means Canadian Revenue Agency. It will show there that he is Single. Goodluck
