Hi

Myself and my Fiance are tying the knot in September. Afterwards she will sponsor me into Canada and I will return to Ireland in case of interview in London.

My question is she is Canadian if we marry in Canada (as planned) is she eligibal to sponsor me??

Spouses, common-law partners and conjugal partners

You can sponsor a person as your spouse if that person is married to you and the marriage is a legally valid civil marriage. If your spouse is of the

opposite sex and your marriage took place outside Canada, the marriage must be valid both under the laws of the jurisdiction where it took place and under Canadian law;
same sex, your marriage must have taken place in Canada and be recognized by the authorities of the province where it took place.

Im confused by your confusion!

It says IF your spouse is opposite sex, you have to be married either in Canada or in a place where the marriage certificate is recognized by the canadian government. I would imagine that includes most, but not all countries. There's probably a list somewhere online. I'm sure Ireland would be just fine.

IF your spouse is same-sex, you must get married in Canada.

Either way, getting married in canada is fine.

The point is that if you get married, and want to apply as a spousal sponsorship, you have to have a legal wedding that is recognized by the canadian government. I'm pretty sure it is hard to get married in Canada and have it not recognized as a legal marriage, but maybe it is possible!!

They're trying to say that it has to be legal in both the jurisdiction where it is performed and in Canada.

A same-sex marriage performed in Ireland wouldn't be valid because it is illegal in Ireland although it is permitted in Canada.

A marriage to a second spouse (e.g. two wives at once) is legal in some countries but wouldn't be valid in Canad because it is illegal in Canada. The same thing would apply to a marriage to your brother or sister if there is some place that allows that, etc.

There certainly is no rule against getting married in Canada.
