Hi everyone! Im kind of new here.

I hope this won't be too lengthy.

I came here 2 yrs ago as a student and currently working as a Nurse but still on a student visa. My visa will expire this April 2016. I've already applied for a post grad work permit but unfornltunately they denied it saying that my school isn't qualified.
If you're wondering how im able to work on a student visa its coz i have a coop work permit.

Anyway, to continue i met this wonderful & amazing guy 3 months ago. Even before my PGWP got denied, we talked about the future.. Of getting married. But with what has happened, and the possibility of me leaving which made us both really worried and that it seems everything is agaist our future plans, we decided to get married this March.

People might be thinking we're doing it just so i can stay but the relationship and the intention of marriage is genuine. What will happen if we get married when my cisa will expire?

Will i go back to where i belong?
Should my future husband who's Canadian should apply for inland sponsorship? If so, will i be able to stay for the time being it has been processed?

I need your enlightenment and knowledge.

Submitting an Inland application, along with an Open Work Permit after you are married, but before your current status expires, is a good plan.

Make sure that you triple check EVERYTHING, before submitting your application, as well as paying the correct amount for the OWP ($155 + $100). The total cost for the PR sponsorship application is $1040. As long as these are received by CIC before your status expires, and (most importantly) they are not returned because of an error on your part (i.e., outdated/missing form(s), missing signature(s), etc.), you will be covered under implied status, allowing you to legally remain in Canada during the processing of your PR application...which could be a couple of years. The good news, is that you would likely receive the OWP within 4 months.

If you have a straightforward application, there's no reason why you can't do it yourself...especially with all the help you'll find around here. If you feel that you do need professional assistance, you might consider using the law firm that generously provides this forum for all of us to use. :)

1. if you apply for inland , you can stay in Canada and work with open work permit.
but if you cannot apply for PR before your sp is expired, then you have to apply for change of status for visitor visa in order to maintain legal status in Canada.



2. if you apply for outland which normally process faster than inland app, you have to apply for change of status in order to stay in Canada or apply for work permit with LMIA from your work.
(assume you are working for hospital or clinic, so they might be able to apply for LMIA for you, ask your employer.)

If you get rejected visitor visa and cannot have work permit, then you have to go back to your home country and wait for your pr .


3. the timing you met your future spouse and PGWP rejection might bring some red flag to VO so you need to provide good/solid proof for genuinely of your relationship.

when you married in March i would apply for your marriage certificate and also send along a copy of your expiring visa , that way you may be able to get it faster. If not i would just send the solemnize part and send the marriage certificate later. I wouldn't normally advise this but you have to stay in status as Pongo said ... good luck and come back to us if you have any other questions..

Thank you for this. It's giving me the positivity we need right now. As i understand, once my student visa has expired and waiting for the PR and OWP, i cant work in my current Nursing job? ...
 
floomy is right you are going to need some solid proof ... i would start now ... get a small life insurance policy out on each other and ask your new to be husband to attach you to his bank account and credit card or join both accounts together.

Not unless the co-op work permit can [normally] be extended. If they can, you might be able to continue to work, because of the implied status that you will have.
