Dear All,

I applied to sponsor my wife in January 2019, but I was not able to stay in Canada during my application processing. I stayed only 40 days then return back because, I faced serious medical issues and I did not had OHIP.

Last october, the immigration emailed me requesting documents about my address and work. They know I am not in Canada. I replied to them and explained that I faced medical problems and returned back. Yesterday, they emailed me and informed me that I am not eligible to sponsor my wife since I am not in Canada and they gave me two options:

1. Get back my application and they will refund the paid fees.. (except $75.0)
2. Proceed with sponsorship application - based on Humanitarian case, but not fees will not be refunded even if rejected.

What shall I do? They asked me documentation to support the Humanitarian case. !!!..I don't know what to do.

Please help.

I would personally withdraw the application since you aren't in Canada (I'm assuming you are a PR). Humanitarian cases generally have a low level of success and you'll find it hard to argue why you needed to be outside of Canada to address your medical issues if medical care is outside of Canada. I would recommend withdrawing the application and then reapplying once your medical issues have been addressed and you have returned to Canada to live here.
 
You were aware that you didn’t qualify and had brought it up in previously posts so you could have withdrawn your application earlier. Your refusal should not come as a surprise. Not sure when you landed or how long you have been out of Canada but you must meet your RO to sponsor a spouse so that might influence how soon you return to Canada.
