Before we all go mumbling our opinions, rant and rave involving politics, let’s take some time to see how this probable spring election may affect the immigration rules in Canada.

Since the position to Minister of Citizenship and Immigration Canada is by appointment, The Honorable Jason Kenney, current Minister of CIC may not be affected by the upcoming election especially if the Conservative party still wins the majority of the seats at the House of Commons. However, if Harper’s party fails, a new Prime Minister will be appointed and even if Mr. Kenney maintains his seat at the House of Commons there is a great chance that he will lost the position as the Minister of Citizenship and Immigration Canada.

That is of course, if there will be an election and if Harper’s government doesn’t win.

Let us then review the regulation accepting applicants under the Skilled Workers and Professionals program in the recent years., and find out how the ongoing speculations for May will affect it.

* November 28, 2008 - a ministerial instruction was issued stating a set of eligibility for federal skilled worker applicants. This was the time the 38 high demand occupations came about.

* June 26, 2010 - the 38 high demand occupation was reduced to 29 occupations the CItizenship and Immigration Canada will accept for processing under the Federal Skilled Worker program.

The ministerial instruction was issued right after the appointment of Mr. Jason Kenney as the Minister of Citizenship and Immigration Canada. The instruction was in compliance with the approved amendment in the Immigration and Refugee Protection act which is removing the obligation to process all applications CIC receives, and authorizing the Minister to issue instruction as to which are eligible for processing...

We have been expecting a change in the list of high demand occupations come June or July this year.

The ongoing consultation on the current FSW system may result to changes in Selection Criteria, to be expected this spring or probably summer this year.

With a probable election this spring, the changes may not be what most of us are expecting. Anyhow, we really do not know what the changes will be in the first place. If a new party and Prime Minister is elected, chances are a new outline to further enhance the system and reduce backlog will be implemented.

Dan Lett mentioned in his column at ‘Fasten your seatbelts as political intrigue takes off’ the following:
“Immigration policy seems aimless, with mounting restrictions on immigration levels even as provinces like Manitoba are making more demands for access to new Canadians to sustain economic growth.

If there really is a demand for new Canadians to sustain economic growth, it will be nice to think of a higher number of occupations eligible to apply under the FSW. The ongoing consultation hopefully will help sustain the need. Another thing to look closely at is the status of the back log brought about by the immigration process prior to Ministerial Instruction. The backlog was reduced by 40%, report states, though there are applicants from 2005 whose applications have not been processed yet.

On the other hand, the processing for new appliants under the FSW program takes 6 to 12 months. It is a good jump from the previous one that is at least 5 years. Additional Provincial Nominee Programs had been implemented to ensure admission of newcomers not only to big cities but to provinces as well.

We can not say if the current Action Plan is better than what the Liberal or other parties can offer in terms of immigration and citizenship. There are only possibilities what with the news, consultation and alleged abuse of office by Mr. Kenney
 
There is ground of lots of array of speculations... but we can just expect and hope that the current processing policy should go on without disruption until new instruction might taken it over!!! Otherwise another backlog will add on the one currently having!!!
 
Yes.... What ever the decession they make it must help the immigrants and the country because Canada always needs Immigration.
